Please help or advice on spouse visa!!! Very frustrating!!!

Hello all,

I am a US citizen and I got married in December 2009 in India. I filed I-130 and I-129 for my wife in the end of January in New Delhi. After submission, we were given a copy of the draft (draft is like money order) with stamp on it saying "received" and told to contact Mumbai consulate for further help in the process. They also stated that we should receive a response from Mumbai within a month.

It has been over 2 months and we still have not received any response. I am back in US now. I emailed and called Mumbai consulate but only response I get is "it maybe in the process". It makes me worried because we do not have a case number or a receipt number for the filed applications.

Should I contact consulate in US? and if I do, which consulate in US I should contact? I do not have a case or receipt number for reference. Someone please help me on this issue as its driving me crazy.

Please someone guide me in the right direction on what I should do.

If you filed with New Delhi, you have no choice but to deal with New Delhi. There are no US Consulates in the USA, just as there are no India Consulate in India or German Consulates in Germany.

If you filed with New Delhi, you have no choice but to deal with New Delhi. There are no US Consulates in the USA, just as there are no India Consulate in India or German Consulates in Germany.

I had contacted Mumbai consulate but with no success. Isn't there a place in US who I should contact to see if they have received any of my files. I am pretty sure they received something in US as I know that submitted I130 forms are processed in US even if its submitted in other countries. I just don't know who to contact to as I have no receipt number or case number.

It appears that you did a Direct Consular Filing.. DCF .. if this is the case, you should have a case #. You can try calling The Department of State and inquire with them, but they may not be able to access the file without a case #. If you email the consulate it may provide some info, or you or your spouse could go to consulate to make an inquiry. The two easiest things are calling DoS and emailing Mumbai.

Thanks, I will try to give them a call on Monday and see what they have to say. It is strange that they did not give us a case number when I submitted file. Am I supposed to receive a case number when I submitted the file?

I filed DCF and never got a case number; most DCF cases never go to the USA (because they are dealt with in local USCIS offices within the embassy) so calling a US based office may not yield any results.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Best to ask these questions in the DCF forum. None of your case file will go to the USA though and the DOS won't have any information until after the USCIS office in New Delhi approves your petition.

You really need to study the DCF Guide.
