I filed my husband's I-90, application to replace permanent resident card, without applying to remove the conditions. We received a letter back from DHS saying that we filed the wrong form

(because I-751 must be filed BEFORE I-90) and that we should have filed to remove conditions within 90 days before. (originally I read this as within 90 days of expiry, meaning 90 days before or after- wrong!) The letter says sorry, now you are in deportation proceedings and this decision cannot be reconsidered. However, you can apply within via I-485 within 30 days to appeal, and you must also file I-751 with a letter explaining what special circumstances kept you from filing I-751 on time. They may or may not approve your application. (sounds very ominous)

Has anyone ever had this issue? We filed all of the forms and fees that they asked, now we have to wait...
