Traveling outside the US on a K-3?

Hi All,

Hopefully someone out there may have experience with a situation we have.

When my K-3 wife initially arrived in the US in late June the immigrations officer mistakenly did not give her the portion of the I-94 that she is supposed to keep stapled in her passport. I have used form I-102 to apply for a copy of this I-94, but that was just last week and I have a feeling it may take 3-4 more weeks to receive this. However, we are hoping to travel to Singapore for two weeks in late August / early September.

Does anybody know if this will be possible?

Can she leave without the I-94?

Or, maybe, is this an easy way to get a replacement I-94?

I am not sure about the I-94 but would suggest calling the airport and asking. Your wife still has her K-3 visa which is good for 2 years. When my husband and I travelled back to Australia in December I was confussed when the ticketing agent went to take my I-94 but was told that they had to take it and that I would get a new one upon reentering the US. So sorry this is probably not a lot of help but I would call the airport that removed your wifes I-94. Good luck.

someone can correct me if I am wrong but I do not think that she can. I see the lack of the I94 as a problem but I could be wrong. maybe try calling border patrol.

Hello, my wife is also in Russia on an AP. She is coming back on August 15th.

We were told that she needs to have our Marraige license with her that shows her Russian name and her new name along with the Advance Parole doccuments and her passport.

It seems seensible. The AP papers are in her new married name, the passport in her old name, the marragie license shows both names belong to the same person.

Hope this helps.

Feel free to travel...

You'd just have to fill out a new I-94 when you came in anyways. They'll just put the expiry date of the status the same date as stamped on the K3 in the passport.

thanks all for your help.....I just wonder if the ticketing agent is going to somehow say no go when Bennie does not have the I-94 to turn in. I will try calling border patrol

I just called border patrol and was told that my wife can not travel outside the country without her I-94. They also said she can not get a duplicate I-94 at her original POE......frustrating!

OMG so what does your wife do then to ever be able to travel outside the US? I hope that you are able to get this sorted out and wish you both the best of luck.

Thanks Debby....it looks like we will just have to hope that the duplicate I-94 form that we applied for last week (via I-102 form) gets processed quick enough to allow her to go in 3 weeks.

You can travel without the I-94, but your wife runs the risk of being denied re-entry into the country. I'm on a K-3 myself, and waiting on my Green Card. However, my I-94 was removed from my passport at the time of my AOS interview. This means if I want to travel before I receive my Green Card, I'd need to apply for Advance Parole.

So yeah, wait for your wife's I-94. Don't leave the country without it.
