Who Should Stay My Wife or Them?

So they are reviewing the law by trying to give amnesty to illegal aliens...thinking about this..my wife jokingly said that she should have been an illegal alien than me filing for her I-485. I am an AWA filer, I did the right by filing legal status for my wife. I submitted documents to prove that I am not a risk to my wife. I have not received any reply yet, 6 months after the RFE was submitted. But now they are considering granting amnesty to those who have stayed in this country illegally...is it right? Is it because I am an AWA filer, but I am a US citizen born in this country.

Eagerly, if your wife is illegal and you are AWA filer, it could be even harder.......I am not sure what to think of the USA... but I am grateful everyday I spend with my husband. We are waiting and waiting as well...

No, she came here legally. She was just joking..as in "what if". In my opinion, if AWA filers are found to be of no risk, the grant of citizenhsip should be given first to our beneficiary(ies) AS WE ARE IN LINE FIRST AND yes we have been waiting and waiting after all the required paperworks have been filed.

Eagerly, if your wife is illegal and you are AWA filer, it could be even harder.......I am not sure what to think of the USA... but I am grateful everyday I spend with my husband. We are waiting and waiting as well...

Even in order to get hardship waiver she would have to spend 10 years in the US before applying! THat is what I had learned recently. Or that amnesty is just an amnesty? But I think in order to qvalify she would have to spend 10 years here anyway.

I wonder, is there going to be a reply from USIS before those 10 years in a country, after comming legally and legally marrying a man????

I came to US on a K3 visa. My Spouse approved I 130 was revoked when I applied to adjust my status due to AWA. My spouse refiled the I 130 even with all the evidence showing that he is not a risk to me, it was denied again.

So be prepared, it might not easy for your wife to adjust her status her.

THat is sad.

I read that approved I 130 can be revoked, unless AOS was finished. Basicly, after USCIS implemented AWA they had to run criminal check on all aplicants whose AOS haven't been approved yet. THose who didn't make in time are out of luck, and have to go through much more complicated way.

I don't want to go off topic, but let me ask what did you do after denial? Did you appeal?

Did they give you the reason for the denial? So what is your status now, having appeal denied?

I am adjusting as a parent of a US citizen. My daughter now a US citizen has filed an I 130 on my behalf.

We did appeal but on the advice of our lawyer we also refiled the I 130 and I 485 so that I don't accumulate unlawful presence. Both appeal and the new I 130 were denied.

You can appeal several times. 1st appeal is paper appeal, that you appeal to court of appeals and you will see a judge. Then you can appeal to fed Court, then Suppreme Court. Well, the last one is for peole who have money, sadly.

We did not do the 2nd appeal as the lawyer's fees was $ 5000. We can no longer afford such fees anymore.Also, I might accumulate unlawful presence.I just hope I might get my green card through my daughter.
