I filed my I485 along with I765 sometime in December 2009. Both got rejected bcuz of incorrect selection in section two of I485.

Resubmitted both January 6.

Received I485 NOA January 14 2010. No NOA for I765.

Called customer service center. A customer service rep told me I had to wait 90 days for a response on the I765.

I waited, did biometrics during that waiting period. 90 days passed, no NOA. 100 days passed, no NOA.

Called customer service. Rep told me theere is no record of a I765 i sent in.

This felt like game over, because now i have to resubmit, and wait another 90 days :S.

Is there any possible way i could get this case expedited?

A friend of mine offered me an electrician job with the boilers, but i couldn't start since i had no permission to work. So i told the guy i would be able to start sometime in march, because i should get the work permit by then.

My wife is also due to give birth 5 weeks from now, and she is still in school, so i need to star working asap.

AHHHHHH!! this is frustrating.

07-27-04 --- We met

10-21-05 --- First Anvrsry

06-xx-06 --- Tamy moved to NY with USC Father

06-xx-07 --- Tamy became USC (before she was 18)

08-10-07 --- Tamy came back for her Grandmother's funeral(spent endless hours together)

09-19-08 --- Visited NY for my Grandmother's funeral(Spent endless hours together) don't get any ideas

01-09-09 --- Tamy visited Ja for two weeks of endless bliss

06-16-09 --- I came to NY for vacation

06-xx-09 --- Got married at city hall

08-15-09 --- Found out we had a little one on the way

09-xx-09 --- Filed I-130

12-08-09 --- Filed I-485 & I-765

12-15-09 --- Rejection notice I-485 & I-765

12-24-09 --- resubmitted I-485 & I-765

01-14-10 --- Receipt Notice I-485 (was told to wait 90 days for EAD)

02-03-10 --- I-130 approved

02-08-10 --- Bio appt

02-20-10 --- RFE medical

03-23-10 --- Resubmitted I-765 (was informed that my application was not in system)

04-09-10 --- I-765 Receipt Notice (may have to do second bio metrics)

05-xx-10 --- Interview

05-xx-10 --- Approved and stamped

I'm sorry this is so frustrating for you and that they lost your I-765. If it makes you feel any better, we filed for the EAD, but by the time we had it.. we only had a 1-2 weeks until the AOS interview. We thought we would have his EAD for a full month before his AOS interview.. My husband still hasn't been able to find a job (it's nice you might have a position waiting for you). I think even if you filed for the I-765 (unless you can expedite it.. i'm not sure if you would be eligible for the expedition), you would get your actual greencard before you received your EAD card.

You need to make an Infopass appointment with your local office.

They may not 'hear you' at first since it has not been 90 days since the receipt date of your NOA.

But if you reinforce that you were told the interim benefit I765 is not even receipted, you may get someone's attention. I would take a new package I765 with me to that appointment, along with whatever proof I could muster that I did send a prior package.
