Lease for Evidence of Bona fide Marriage

Hi

I am applying for AOS for my wife from student visa and I wanted to know how we can include the fact that we are living together. We currently reside together in my father's apartment and the lease is in his name. All the utility bills are in his name too.

Also would this be enough:

1. Pictures of us with our family members

2. Joint bank account

3. IRA account with my wife as the beneficiary

4. Life insurance with my wife as the beneficiary

5. Credit cards with our names and same account number

6. Her drivers license showing that both of us have the same address

I-751 Timeline:

05/06/2012: Window Opens

05/03/2012: Mailed out Package

05/11/2012: Received NOA-1 (dated 05/07/2012)

06/19/2012: Biometrics Appointment

I take it you will be adjusting due to the fact she married you (the USC)?

Then you need to provide the marriage certificate as per the guides.

That other stuff you have is not needed for adjustment of status. However, it would be needed for removal of conditions later.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

A sublease from your dad to the two of you would be another piece of evidence. Or even an affidavit from your dad stating that the two of you have been living there since xx/xx/xxxx (that's what we did while living in my mother's house).

Bobby- I disagree, since they are filing the I-130 in addition to the I-485.

The I-130 lists 6 types of things to submit, in the instructions.

The I-485 is not so specific, alas.

asdic - I think the joint bank account is good - but the fact yer living in the father's apartment, with out any paperwork trail there, on the two of you, might hurt you a bit. Are you paying rent to your father, at all? If so, prepare rent receipts in BOTH names. Ahn-map's got the gist of it, though.

It's weird you not have utility bills in both of yer names (husband and spouse) - no cell phone? I think the cheapest way to show something else would be 1--internet service provider and 2--vonage account - both in both names..

Does the CREDIT CARD STATEMENT include both names in the 'bill to ' section? That's a thing that will TRUMP MOST, if no utility bills in both names.

Also - suggest you include MONTHLY STATEMENTS on the JOINT BANK ACCOUNT.

re: IRA and Life Insurance - Make SURE THE POD (payable upon death) instructions are there, with the submittal, highlight her name.

you should prepare a coversheet /coverletter specifically going over the evidence.

You can also make letters of attestation / affadavits from people that know the two of you are married.

----

Remember - although you are submitting two major formsets - assume evidence included in one will not be reviewed for the other - so, when needed, make duplicate info (specifically the copy of the marriage certificate).

I was referring to the 485 (AOS) not the 130 (petition for alien relative). I thought that was the form he was talking about (not including the 130) - my bad. wink.gif

I applying for concurrent filing ie I130 and I485. I dont make any payments to my father, I will just an affidavit saying I live at his home with all utilities under his name.

Also, my credit card company will not add my wife's name to the Statement because she will need an SS number.

No SSN ? wow - thats a bit strange.

USUALLY, an F1 visa holder will qualify to make the application.

It's not needed, for most things, though.

If you are on F1 visa and you are a student, you only get a SS number if you apply for OPT. If you are a student attending school, the SSA will deny you a SS number because you are not authorized to be employed while you are in school.

T-mobile uses only the "primary account holder" in the billing statement even if you have a family plan with multiple lines. Since I am the primary account holder, I cannot add my wife even though we share the same plan. There cannot be 2 "primary account holders".

Let me inform you, as a F1 myself that she CAN get bank accounts and possibly credit cards without a SSN. I am currently with Bank of america who allowed me (and my mom, on second F1 with several credit cards) to open and successfully received a Student Platinum Credit Card by way of submitting only Passport documentation and I-20. So I would suggest that you both try to get her a credit card and add you onto the account.

As far as T-mobile is concerned (also a customer) hubby got me my own line when we were dating and last year we got a family plan. Although account was under his name, HE ADDED ME AS AN AUTHORIZED USER. I'd suggest that if you guys have the same family plan, that you ask T-mobile to send you a print-out or you go onto the website and print out a copy of your phone-bill showing both your line and her line on the account. The phone bill itself could be a supporting evidence as it shows your communication and when/if you need to present it to the IO, tell them she could not be added to the account because of her not having a SSN but she is an authorized user who can make changes/payments to the accounts etc. If you talk to each other a lot and phone records are too many pages or you dont get a mailed bill, just go to the My profile section on-line and print out that page that shows billing address, name on account and phone lines on account. Also there is a feature that lets you NAME the lines (also on my profile page at the bottom right) so you can type in and save her name to her line.

Also, did you pay any of her tuition or bought her books? The evidence does ask for major purchases as proof of bonafide marriage. Also, you could include the purchase of her ring. Try to think of any other evidence you can include like letters or cards... Anything else you'd wanna include.

But so far you have great evidence.
