For the American to get married in the Philippines, he will have to go to the American Embassy in Manila and get an AFFIDAVIT OF LEGAL CAPACITY TO MARRY.

You can got to either Manila or Cebu to the US Embassy for that Legal Capacity to Marry document. Some things will depend on where in the Phils you get married and what docs the province/barangay require. For us we had to get quite a few docs lined up:

Capacity to Marry from Cebu

Barangay clearance for her

Marriage counceling (Certificate)

My original divorce decree

Both birth certs (Originals)

CENOMAR (made me get one too)

Affidavit of Singleness

After you submit all the documents there's a 10 day (calendar day) waiting period. If he's Catholic, have him bring a RECENT baptismal record otherwise you won't be able to have a church wedding. There is a lot of time involved even if he is - seminars and banns

well if his flight comes into Cebu at 7:30 AM he can have it by 10:00 AM

thank you for ur reply. so there must be a total of 8 mos before she got her CR1 visa? would u advice my fiance to get a lawyer for us to easily get my spousal visa? thank u.

In my opinion, if you follow the guides on this site, there should be no reason to hire an attorney. Hiring a lawyer doesn't make the process move along any faster. Easier perhaps, but not faster. Plenty of folks have gone it on their own, and have had no problems. Yes the wait sucks, but we have all gone through it, even though it can try your patience at times. Also, the average timeline for a CR-1 in Manila is running around 5 months. Good luck on your marriage, and good luck on your visa journey!
