my fiance and i are getting married in the Philippines on July 24th '10. i wanna ask what are the steps/requirements we need to accomplish before getting married. he's an American. Thank you! :star: :star: :whistle:

For the American to get married in the Philippines, he will have to go to the American Embassy in Manila and get an AFFIDAVIT OF LEGAL CAPACITY TO MARRY.

You can got to either Manila or Cebu to the US Embassy for that Legal Capacity to Marry document. Some things will depend on where in the Phils you get married and what docs the province/barangay require. For us we had to get quite a few docs lined up:

Capacity to Marry from Cebu

Barangay clearance for her

Marriage counceling (Certificate)

My original divorce decree

Both birth certs (Originals)

CENOMAR (made me get one too)

Affidavit of Singleness

After you submit all the documents there's a 10 day (calendar day) waiting period. If he's Catholic, have him bring a RECENT baptismal record otherwise you won't be able to have a church wedding. There is a lot of time involved even if he is - seminars and banns :(

how long does he need to be here so he can get an Affidavit of Legal Capacity to Marry? thank you :star:

well if his flight comes into Cebu at 7:30 AM he can have it by 10:00 AM :)

2007-10-12Hubby's first visit/met me and picked him up in Davao International Airport

2007-10-17Officially engaged to my one and only love hubby & formally proposed in front of my family

2007-10-22Flew back to the US

2008-02-022nd visit of my hubby and picked him up at Cebu International Airport

2008-02-04Went into the US embassy Cebu to get his certificate of legal capacity

2008-02-05Flew back together into Davao City and drove to Tagum City

2008-02-27Our awaited precious moment the WEDDING DAY!!!!

2008-03-04Hubby Flew back to the US

2009-05-013rd visit of my hubby and picked him up at Hong Kong International Airport

2009-05-02We went to Hong Kong disneyland (pretty amazing)

2009-05-03Flew back together into Manila and got his balikbayan visa to stay here with me for one year

2009-12-24First time we celebrate together the Christmas Eve (very much awesome!)

2009-12-31First time we celebrate together the New Years Eve (very much happy)

2010-01-07We celebrate together on his Birthday!

2010-01-15Celebrate together on his cutie wifey Birthday!

thank you for ur reply. so there must be a total of 8 mos before she got her CR1 visa? would u advice my fiance to get a lawyer for us to easily get my spousal visa? thank u.

In my opinion, if you follow the guides on this site, there should be no reason to hire an attorney. Hiring a lawyer doesn't make the process move along any faster. Easier perhaps, but not faster. Plenty of folks have gone it on their own, and have had no problems. Yes the wait sucks, but we have all gone through it, even though it can try your patience at times. Also, the average timeline for a CR-1 in Manila is running around 5 months. Good luck on your marriage, and good luck on your visa journey!
