I submitted my AOS and just received an RFE asking to make some corrections. However, I just found that my father (who is my sponsor) did not make enough money to meet the requirements in his 2009 tax return. Can I submit a new AOS for a new sponsor with the RFE?? or should I keep my father as a sponsor (and make the corrections) and add a new sponsor as well?

Advice Please

What is the correction they are asking you to make on your AOS?

They say there were mistakes where my father signed the documents. However, my father just filed his 2009 tax returns and no longer qualifies so I don't know if I should just submit a new I-864 with a news sponsor (in the RFE) or keep my fathers I-864 (make the changes) and add another sponsor that meets the requirements.

Since deadline for 2009 tax filing is fast approaching I believe you will be asked to send 2009 tax returns at some point either at NVC stage or interview stage. Therefore, It is better to be ready to produce another co-sponsor.

I suggest you to send the corrections in response to RFE at this point and if you can find another sponsor, include a letter of explanation to why you would like to use another sponsor and submit I-864 for him/her as well. Make sure not to confuse people at NVC by just sending another I-864 without an explanation.

Please pm the member pushbrk who might be able to give you a more precise answer on this issue.
