K3 - i130 is not going anywhere

Hi,

I am a US citizen and using the K3 process and has submit the I130 form to USCIS and since then I have received the first NOA1 and since then I havent heard anything else.

Am I missing something? or is there any additional paperwork I need to submit to get the process roling again.

I am checking My case status and now it's on "Post Decistion Activity"

Please let me know what I need to do to move forward on the K3.

Filing the paperwork on APril 09, received NOA1 on September 09 and since then I havent heard of anything else.

Perhaps you moved and didn't receive the notice. If you only filed an I-130, you're on the CR1 visa path, not the extinct K3. I would call NVC and see if they have your case.

The number on your NOA-1 is not NVC. It is USCIS and yes, they are useless

Call the National Visa Centre at 603 334-0700 and find out where your case is, You'll need your USCIS case number

The number on your NOA-1 is not NVC. It is USCIS and yes, they are useless

Call the National Visa Centre at 603 334-0700 and find out where your case is, You'll need your USCIS case number

You filed in April and got your NOA1 in September?

Surely, that can't be right. You must have received your NOA2 if the website is showing as POST-DECISION ACTIVITY.

Call NVC ASAP and inquire about your case status.

You keep trying. I contacted them twice today. Does the word "approval" appear anywhere on the notice you received in September? If so, that's the NOA2 and you never got NOA1.

You don't need to speak to a person to determine whether they have your I-130. The automated system will tell you. Follow the prompts. It works 27/7.

Check the AVR. With your USCIS case number. It'll tell you if NVC has your case and when it was assigned a case #.

The hardcopy NOA2 is not important in the grand scheme of things for the CR-1, from what I understand.

Sign in to the USCIS website. And enter your case number. Where it says POST DECISION ACTIVITY -- does it say anywhere below that this I-130 petition was APPROVED on September 14?

Post-Decision Activity

On September 14, 2009, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

Okay. So that sentence -- On September 14, 2009, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN -- means that your I-130 was approved often also referred to as the NOA2. You just never received the hardcopy.

CALL NVC NOW.

I'm confused--your profile says K-1 but the USCIS blurb says I-130.

Could you PLEASE clarify once and for all so that people can actually help you instead of trying to beat information outta you?

Please consider filling in your timeline.

Want to said thank you to everyone, I was able to talk to the operator via the NVC number and find out about my case.

The operator told me I should have received a call from them 4weeks after the NOA on September 14, 09 since I havent heard anything from them, I have update my phone and email address for my receipt number. They will contact me via email the next 2-4weeks to let me know the process or next step. The paperwork look correct.

Want to ask, what is my next step in the process that I need to do.

Now you wait for them to Email you the AOS/DS3032 links.

Tons of work to do, if you haven't already. Get your PCCs, tax stuff, birth certificates etc, in order.

The case number? I dont have it, just provide the receipt number via the NOA paper I received.

On the PCC and tax and all the information, I have provided everything in the I130.

I will head over to the March 2010 NVC thread and look for more information.

Thanks again for all the help and i did update my timeline/profile to show K3.

Why did you send those things in with the I-130? They are NOT required for USCIS. You will probably have to submit all of those things again for the NVC process.

You now have a new case number that was assigned to you by NVC. Probably start with the letters MTL for Montreal or something similar. Call the AVR, listen to the whole message--it will say "NVC received this case on...The case number assigned is..."
