Hello everyone! My husband is now in the process of legally adopting my 5 yr. old daughter. Also my daughter and I are set to remove conditions this AUGUST. If and when the legal adoption will be final before we remove conditions, does this mean I don't have to file for my daughter since automatically she becomes a US citizen right?

Anyone who has undergone this process kindly share your input.

If you are a citizen you are no longer a resident... If you are no longer a resident you no longer need a 10 yr greencard.. If you no longer need a 10 yr greencard you do not have to file an I-751

The Child Citizenship Act of 2000 is a United States federal law that allows certain foreign-born, biological and adopted children of United States citizens to acquire U.S. citizenship automatically. These children did not acquire U.S. citizenship at birth, but they are granted citizenship when they enter the United States as lawful permanent residents. The law modified past rules for child citizenship, which only allowed citizenship to be granted through the male parent[citation needed].

The child must have at least one U.S. citizen parent by birth or naturalization, be under 18 years of age (have been born on or after Feb 27, 1983)[1], live in the legal and physical custody of the U.S. citizen parent, and be admitted as an immigrant for lawful permanent residence. In addition, if the child is adopted, the adoption must be full and final.

The effective date of the Child Citizenship Act is February 27, 2001. Children who met the requirements of the Act on that date automatically became U.S. citizens. Children who were 18 years of age or older on that date did not acquire U.S. citizenship from the Child Citizenship Act of 2000.

The Act is known as Public Law 106-395, and is codified at 8 U.S.C. §§ 1431-33.

yes, if and when the adoption becomes final before you're due to remove conditions your daughter becomes a citizen and doen's have to renove conditions. :)

INA: ACT 320 - Children born outside the United States and residing permanently in the United States; conditions under which citizenship automatically acquired 1/

Sec. 320. [8 U.S.C. 1431] (a) A child born outside of the United States automatically becomes a citizen of the United States when all of the following conditions have been fulfilled:

(1) At least one parent of the child is a citizen of the United States, whether by birth or naturalization.

(2) The child is under the age of eighteen years.

(3) The child is residing in the United States in the legal and physical custody of the citizen parent pursuant to a lawful admission for permanent residence.

(b) Subsection (a) shall apply to a child adopted by a United States citizen parent if the child satisfies the requirements applicable to adopted children under section 101(b)(1) .
