I-130 for stepchildren

Timeline

My husband filed for my son.

3/31/2010-Sent the Packet including Form I-130 fees and documents.

4/12/2010- Check Cashed.

--End of update--

3-31-2010--Form I-130 was sent to chicago lockbox.

4-12-2010--Check Cashed.

4-05-2010--Packet Received USCIS.

4-12-2010--Notice Dated.

4-17-2010--Received the NOA1.---- End----

i think since the thread here is all about step-kids,maybe someone here will offer me the info i need.My husband is the USC and he is living overseas,so he petitioned for my visa thru DFC,but unfortunately,my son...his step-child lives in my home country with my parents.So,how do we get started on doing his petition??

this is what i got from the uscis website:

requirements;

form I-130

my USC husband's copy of his birth certificate

my son's birth certificate

our marriage certificate

now,my question is,is this all we have to send on our initial application or do we need to include the child's bio-page of his passport and his passport pics too?????

ooh,and still on the same topic,i read on this thread about a letter from the other parent to the child,....in my situation,my son's father's name is not included on his birth certificate.....so,do i still need a notarized letter from him when sending my petition about him not having any objection to his son immigrating??????

Those are good questions in both posts and I wish I had an answer to even one. I think that regarding your stepson, your husband may have to file the I-130. I don't know if he will qualify for a K2. For the I-130 he just has to complete the form and send it with the fee and the other documents (birth certificates and marriage certificate) and then wait for the NOA2. Once that happens, he'll start the NVC stage of the process.

As far as the letter from the other parent, I don't know. It seems that if there is no legal father, there is no one to write the letter.

Just starting the journey, haven't yet filed... Until today(2/12/07)!

7/6/07 - VISA delivered!!!

7/21/07 - Fiance arrives

I didn't read this part of your post. I don't think those items are required for the I-130.

Sorry, I didn't realize there were more responses in this thread. The letter that I'm referring to was an RFE we received before the I-130 was approved. We just sent in a typed letter stating that the mother and father of the children were never married, and therefore never divorced. It was signed by my husband but not notarized. It was accepted, our petition was approved within a couple of days after they received it.

There is a separate letter that will be required from the mother before they can receive their visa that states that she gives permission for them to leave the country.

Was the RFE similar to this:

Marriage termination- submit a legal copy of the final divorce decree signed by a judge or magistrate that shows proof of filing, or the death certificate issued by the civil authorities, that terminated the prior marriage of the natural parent of the beneficiary ( stepchild) ' wife.

I received a RFE regarding a I130 petition for stepchild and my wife was never previously married. Child was born out of wedlock. Both parents names are on the stepchild's birth certificate.
