My I-94 was expired but my passport is valid. I have to travel domestic trip before AOS approved (if EAD approve, this card is enough for second ID?). I plan to take my passport, NOAs and marriage certificate. Is there any document needed besides those?

Thanks for any suggestions.

You're very, very smart & prepared. Take a COPY (not the original) of your interview appointment letter or NOA (receipt notice for AOS) with you, just for safety. If your I-94 is expired, you do not want to give ANY Federal agent reason to question your status, anywhere you might be.

Before my wife got her green card, I had her carry a copy of her MOST RECENT paperwork with her, everywhere. This included the copy of our cover letter (+ copy of the $1,010 check) for AOS -- after we applied but before the receipt notice came. It goes without saying that you should also carry your marriage certificate with you everywhere, until you receive your green card.

Do not believe the cavalier VJ members who will say "don't worry -- you can travel domestically anywhere, without problems." You may not ENCOUNTER problems, but you want to be prepared in case you DO. Our government has unlimited time & resources to make our lives miserable. Avoid making yourself a potential victim -- carry your most recent paperwork and your marriage certificate with you everywhere, at all times.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Ive traveled many times domestically and never had to show anything other than my photo ID. Theoretically any airport is a POE so you can be stopped by an Immigration agent and asked to produce your documents but It never happened to me and I flew from small airports to larger ones.

What you have is enough.

Thanks for your advise and suggestions, TBone. Plus I will receive AP in few days because my AP have been approved. With AP and marriage certificate, ofcoz with passport, I think I won't have problems to travel domestically, right?

AP is for international travel only. If your passport is valid, and if you'll use it for identification at the airport (if you're flying), and if the name on your passport matches the name on your airline ticket, you're fine. Again, keep copies of all of your most recent paperwork (whatever that is at the time) with you, purely for peace of mind in the unlikely event that a Federal agent demands it. (If you're driving within a 100-mile radius of either U.S. border, that likelihood increases exponentially.)

Thanks again. TBone. I will take all paperworks with me.

Wait...

Do you have the NOA from the AOS filing?

(since you state your about to get the AP, I am thinking most likely)

If you do - then your status is safe (since you are in the process of adjusting).

Carry that NOA with you along with your marriage certificate. That should get you through any ICE issues.

(Just looked at your timeline - you state you have the NOA for the 485 - your good to go with status issue)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yes, I got all NOAs. I'll take all these with me. Hope I will get EAD before my trip. :DEAD can be used as ID?

You just need the NOA for the 485 (that's the status one).

EAD as an ID? Depends on who is requesting it, but I would stick with the passport.

If you have gotten a state drivers' license, you can use that as ID to travel domestically. You can bring your passport with you, but if you can get away with only showing the license, then there's no chance that anyone will accidentally see that your I-94 is expired and give you any hassles.

Unfortunately, I don't have DL because DMV don't want to issue me as my I-94 was almost expiring. I went there 1-1/2 months before I-94 expired. Thanks for advising. I appreciate it. :)
