Hi There,

After nearly 6 months of waiting from filing our K-1 we received a letter from USCIS telling us that we need to provide proof of meeting in person in the 2 years prior to filing. We did provide proof at the time of filing in the form of pictures, emails, a copy of my date book entries, our e-harmony profiles and messages, and a letter detailing times, dates and locations of our meetings. Our passports also get scanned every time we cross between the Canadian and US borders plus we both have Nexus cards. It seems immigration is confusing our application with an oversees situation since they have asked for proof of stamped passports and trip itineraries. This proof doesn't exist since we drive the 2.5 hours to see eachother every weekend.

Does anyone have any suggestions on where we should go from here, or what other proof we could provide to immigration?

How about hotel receipts?

Printing out your trip entry/exit from your online NEXUS profiles. That should suffice

USCIS isn't so much confusing your case with an overseas petition as much as they're saying what you did send isn't sufficient (their suggested list of acceptable evidence is a 'canned' list, meant for anyone being asked for proof. They don't tailor make a list for each petition).

There are plenty of Canadians on VJ - I imagine you'll have a whole page of possible solutions before the day is out. I'm sure it will all work out.

Any chance Nexus offers some kind of report you could print off showing entrances and exits? or even if you can contact Nexus for that. Like you...many of us drove and stayed at one another's houses - no hotel receipts and only occasionally a plan ticket.

I would simply write a detailed letter (yes...again) and explain the situation precisely as you have here. I assume you can list the trip dates, even if it was every weekend?

Hi! Not sure if you submitted photos this way, but when we filed for our K1, we dated all our photos and wrote down the "event" at which the photo took place (ie. graduation, someone's wedding, random date, trip to this place, etc.). We also included photos with family and friends and I think it helped establish that our relationship was ongoing.

I would also give them a copy of the passport stamps showing the two of you crossed borders to see each other.

Thanks. Well I signed on to my Nexus profile and I don't see a place to print reports. I can give them a call. We did write a very specific and detailed letter when we filed, but I suppose worth another try. I thought about having family members and friends provide us with affidavits as proof of us meeting in person.

Congrats on the Green Card! We did provide an array of photos as a couple and with family members, dated and listed. ugh. Passports don't get stamped crossing between Canada and the US. ugh again. Thanks for the info:)

Hei, just don't panic.

I have the same problem, no stamps in my passport.

Than I contacted the Ministry of Interior in Bulgaria. They was so quick with the respond and I got a certificate with all my exits and entries for two years period from Border checkpoint, even with the time and with ministry's seal.

Just try to contact US Customs and Border Protection, they may help you or just travel again to Canada and ask the officer, who is scanning your passport.

Just two of you concentrate and think about everything that you have done together and you will see that you could find so many proofs. I was almost giving up, but than we found so many proof that I forgot about them - shopping cards of both of us with pictures, a delivery note, signed by me but on his address.....It took us 1 month to get all of them and also translated.

How did you pay for things like gas & food?

Can you provide credit card/bank account statements from when you were each on the other side of the border?

Best wishes!! Hope you get everything together quickly and be able to get on with the process. The receipts will be great, especially if you both have them, to show you were in the same town, same time...:)
