How soon can a CR1 be filed from returning from the U.S.?

I have received a I-130 notice of denial. Was adjusting from F1 Visa to permanent resident as my wife is a USC.

I'm currently appealing the denial. If I'm unsuccessful I will return to the U.K. as soon as possible in order not to overstay.

How soon can my wife send the I-130 to petition me (cr1) once I'm back in the U.K.?

How soon can my wife send the I-130 to petition me (cr1) once I'm back in the U.K.?

She can send a new one now if she wants. Just have her note you'll be applying for a visa in London. It's part of the form.

Removal of conditions Journey

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Don't forget to get your marriage situation straightened-out, the whole married in Florida first then later in Alabama mess can still #######-up a normally straight-forward CR-1 filing for the same reasons it's messing with your current AOS.

Absolutely. Don't know how people get themselves in these kinds of messes, but it usually results from a dishonest act. To get a marriage license, you must sign a statement indicating you are unmarried. Married in Florida is married everywhere on Earth, the moon or any planet you manage to travel to in your lifetime.
