I have received a I-130 notice of denial. Was adjusting from F1 Visa to permanent resident as my wife is a USC.

I'm currently appealing the denial. If I'm unsuccessful I will return to the U.K. as soon as possible in order not to overstay.

How soon can my wife send the I-130 to petition me (cr1) once I'm back in the U.K.?

She can send a new one now if she wants. Just have her note you'll be applying for a visa in London. It's part of the form.

Thanks, whereabouts on the form does she state i'll be applying for the visa in London? Or do should be mention it in the covering letter explaining the situation etc.
