The Constitution does not give explicit right for states to secede and the Supreme Court has ruled that secession is unconstitutional.

9th and 10th Amendment.

It doesn't say the Government can make people buy health insurance either.

From what I understand, there has to be an economic impact factor. I'd encourage everyone here to read the post right above yours because it contains legal opinions from conservative constitutional scholars regarding the Commerce Clause.

I don't really see how this bill violates the constitution, but on the other hand it does set a terrible precedent.

And everything has an economic impact. What people buy has a huge economic impact. Having children also has a huge economic impact. While legal precedent seems to indicate this is the present interpretation of the commerce clause, this interpretation makes the commerce clause an anything clause, essentially.

Where specifically in either the 9th or 10th Amendment does it give explicit rights for states to secede?

Yes, there aren't a lot of things specifically spelled out in the Constitution, however, we can look at Supreme Court rulings to get an indication of what has precedence or not. Secession clearly does not.

I'd actually be willing to make a sacrifice/trade here.

De-centralize our banks and I'll sign up for their health care program. Abolish the Fed, return money powers to the treasury, take the dollar off the 'market' and have it backed by several commodities.

Than we can talk.

Abolish the IRS, then we can talk.

Paul, be honest here - what do you think is the likelihood that any of these lawsuits will hold up in court? These aren't just liberal law professors trying to twist the Constitution...this is their expertise. With so much at stake, it would have been stupid for the President and Congress not to consult with constitutional scholars on individual mandates.

I'm rather curious as to how those who consider health care as a privilege view those who are born with congenital defects. Dependent on the severity of the illness caused by the defect such people are more or less dependent on health care for the right to life. How should these people be treated to give them equality of opportunity?

SMR - go back and reread the conversation that was taking place up to the point in which you brought up children. We're talking about when the Commerce Clause has jurisprudence.

Sofi, the Attorneys General are taking this fight to the courts where Obama will have no say in the matter, unless you want to count who he appoints to the Supreme Court over the next 3 years, but even then, the court is heavily stacked with conservative justices.

Depends on how much the current supreme court is willing to stretch the constitution, and i mean STRETCH.

In all reality though, with 14 states filing lawsuits so far and 36 total states working to legislatively block the mandate, the supreme court's hands might actually be tied. It could be a forced upon issue as that is 2/3 of all states disagreeing with the legislation for a multitude of reasons.

This isn't to mention the backlash of individuals who might take things into their own hands if the courts uphold the federal mandate.

I choose not to have health insurance and don't want it. I'd be willing to be a test case against the permissibilty of punishing citizens for NOT engaging in commerce by mandate.

She is one of several people in this board who maintain that they would rather pay out of pocket for health care, for seemingly ideological reasons because there is no way this can be viewed as fiscally conservative.
