So our petition got returned on March 11th. To this day, it still has not arrived at the NVC ?

What do we do at this point ? I am getting a bit concerend here since the petition expires on April 11th.

when my case was returned on May 17 2009 it took about 3 weeks to arrive at NVC It never showed up on the automated system I had to speak to a agent it will stay at NVC a couple of weeks then two more weeks to get to USCIS It was received at USCIS June 29,2009 remember it is travel snail mail through the government and yes they still have it almost one year later

When our first petition was denied it left the Embassy in April and got to USCIS in May. It only stayed with NVC a few days before going to USCIS. You can call NVC and they can give you the tracking number or Diplomatic pouch number to track. Get your sentor involved... we need IMMIGRATION REFORM to help alleviate these type of issues.

I am not sure what you are asking here regarding the Petition. It appears from timeline you have gone through NVC processing and at

the interview in country the VISA was denied? Petition returned march 11th to where? If the VISA was denied you have to find out why and then find out if a waiver is available for the inadmissability.

It says it in my timeline. I already had my interview, according to the officer I dont have a real relationship,

my petition is getting returned to USCIS. It got sent on March 11th. To this day it has not made it back. I called the NVC, USCIS. I want to refile.

I presume you're prepared to address the reasons for your denial...you have compiled more evidence attesting to the bonafide nature of your relationship? Depending on USCIS, once they receive your petition from the consulate, they will either administratively close your petition, and notify you of said 'closing', OR send you a NOIR (Notice of Intent to Revoke) letter. This is like an RFE and gives you a specific timeframe to respond with evidence to refute the findings of the consular official. Upon doing that, CSC may decide to re-affirm the petition and send it back to the consulate for yet another interview. (This would mean no re-filing is necessary). I would not rush to re-file, because first you must make sure that your initial petition is either closed, or you've responded to the NOIR letter.

Unfortuantely, there is no timeframe for how long this will take....just like there is no time frame for approval of fiance/spousal petitions. It has been less than a month since the petition has been returned stateside....give it a little more time.

In the meantime, focus on making sure that the reasons why you were denied at interview are no longer valid. "No real relationship" is pretty vague. What exactly did the CO find questionable...did you not make enough visits to your fiance's country? What documentary proof did you offer regarding the validity of the relationship? See if you can make another visit to your fiancee's home, or meet in a third country if needed. Continue gathering evidence to document your relationship...and as hard as it is...be patient. Good luck.

Our interview was May 3rd and they say they it back to the USCIS on May 16th 2011 but the NVC says they dont have it yet. Since my petition is coming from the U.S. embassey in Nigeria, i guess I have to wait 3 months too? Or does it depend on the reason the petition is being sent back?

When our first petition was returned the interview was in early August and the petition didn't get back to the states until late October.

Nigeria likes to sit on K1 petitions to let them expire, which gives USCIS an out on havning to really look at the reason they were returned. They will look at it if you file another petition. Nigeria will also lie to you about when the petition is really gone. They were telling me that it left almost immediately after the interview and it actually sat there for over 60 days. I am not sure if they are as slow with CR petitions, but those don't have the same expiration clock running.

This will not be over quickly. You will not enjoy this.
