me(immigrant from india on f-1 and opt complete) and my wife(usc) got married in texas on 14th october09 in the court with some close frnds attending .we lived together for 6months until she got a job in california.she took that job as my inlaws were already there.I had a family emergency and had to come back to india in late feb. I had to stay to look over some family issues and forgot to extend my opt before the deadline.we never filed for I-130 as i was gng to apply for h-1 and gc through my job. Now that my opt has expired . i was wondering if i could still apply for h-1 through my company or will have to apply for the k-3 or or IR1/CR-1- through my wife.

WHY YOU WANT TO FALL IN H1-B STUFF, and ofcourse IR1 is fastest option and very easy way out. K-3 is also a good option, but now a days K-3 visa and IR-1 VISA both are having same time. 5-6 months.

So it's always better to go through, IR-1. Besides, you will also save money in IR-1 compare to Adjustment of Status.

07-19-2021 - received message from NVC about case can not be processed unless all civil documents are submitted (was missing police clearance)

08-12-2021 - submitted police clearance certificate - which was last document submitted to NVC

11-05-2021 - Case completed at NVC - DQ

03-31-2022 - Interview letter received

04-28-2022 - Interview date at mumbai embassy

CR-1. You don't qualify for IR-1 until you've been married for two years.

You enter the US with a green card instead of having to adjust status in the US on a K-3.

CR-1 also costs less in the long run.

K-3 is obsolete.

Can someone please explain to me what is the difference between CR-1 and IR-1 visa? I have been married for 4 years now,i am in the middle of I-130 process right now,so what would be the most suitable visa type for me, CR1 or IR1 ?

If you've been married for more than 2 years, you will receive a IR-1. Which is basically a 10 year GC on arrival.

The K-3 is dead.

03/27/2009: Engaged in Ithaca, New York.
08/17/2009: Wedding in Calcutta, India.
09/29/2009: I-130 NOA1
01/25/2010: I-130 NOA2
03/23/2010: Case completed.
05/12/2010: CR-1 interview at Mumbai, India.
05/20/2010: US Entry, Chicago.
03/01/2012: ROC NOA1.
03/26/2012: Biometrics completed.
12/07/2012: 10 year card production ordered.

09/25/2013: N-400 NOA1

10/16/2013: Biometrics completed

12/03/2013: Interview

12/20/2013: Oath ceremony
