How to Withdraw AOS or Affidavit of Support?

Timeline

My wife has recently informed me that she intends to leave me when she recives her Green Card. She wants to find someone younger and/or richer. It seems like the only reason she married me was to come to the United States. I love her very much, but a marriage can't work unless both want it to.

Since this wasn't a "true" marriage on her part, I want to withdraw the AOS or Affidavit of Support. Does anyone know how or what I should do to do this?

A little background: A couple of weeks or so ago, we received a notice that our file had been transferred to California (we are in Texas). This means that there will not be an interview. If may already be to late, but I want to try to stop it.

I'm so sorry to hear your situation.

I'm assuming this is a conditional 2-year green card? When were you married?

If you are financially supporting her, she will have problems when it is time to remove conditional permanent residence status. She will be unable to prove a bona fide marriage. This will lead to a denial of a 10-year green card, and removal proceedings will ensue.

Or, if you do get an RFE...just ignore it. Eventually, your application will be considered abandoned. But if it is already transferred to CSC, most likely...the green card is on its way.

Again, sorry to hear your situation. Terrible, just terrible.

My sympathies are with you. From what I know, the only way to withdraw an application is to write a formal request. Maybe you can send one to CSC, indicating your case number and then the reason you're withdrawing your application. I think you should really withdraw it since if she gets the GC, that will only give her the opportunity to find a younger man and you will give her ammunition to succeed in her plans. Im not saying you should be vindictive, but I believe in honesty and respect. You deserve better

Send a notarized statement to CSC withdrawing your AOS.

Sorry to hear about your situation.

As the petitioner, you withdraw your financial support, you you withdraw your I-864. I would do as suggested above, as well as get an infopass to ensure that there isn't anything else you should do or a different address to send it to. Take another copy of your notorized withdrawal to the infopass.

Also, get started on your divorce.

K-1:

January 28, 2009: NOA1

December 23, 2009: NOA1!

I am in the process of getting an attorney to file for divorce. I will also sent a notarized withdrawal letter to CSC, and hope that it is not too late.

Things are starting to get worse. She went to visit a friend yesterday, and didn't come home last night. All of her things are still here; so, she will come back sometime.

Also if you suspect immigration fraud, you should report her to ICE. Immigration.Reply@dhs.gov or you can phone them - 1-866-347-2423

Do try to maintain your composure and not hint her as to what you intend to do as she might try to manipulate the matter even more. Please be prompt and take care. Neither you or anyone else deserves such treatment. All the best

As your case has not yet been approved do this:

1. send notarized/ delivery confirmed letter to CSC VIA EXPRESS POST

2. Make info pass appointment and provide copy of the letter.

3. Call Ice

4. File for divorce

5. Protect yourself assets/property/claims of domestic violence.

and do part 1 especially NOW! If you wait until it is approved then it is too late.

Kick her out of the house. Make sure she is NOT living with you. Some people try and fake abuse to get the GC and you are left with spousal abuse against your name. Do NOT allow yourself to be alone with her. Have someone (or several someone's) come over while she packs her things (and watch she doesn't steal anything) or pack her things for her.

Have her leave the property. If she can stay out overnight she has somewhere to stay. Perhaps consider giving her $20 to call someone (or home) or get food or something (if you want to be extra nice).

Can I have the address of where to send the notarized letter of "Affidavit of Support" Withdrawal? You wrote CSC, but I dont know where I would find that particular address
