Usually, if there's doubt regarding the parentage of the child who is immigrating.

Your child is a USC as a result of her birth in the US. And via you, the mother.

I read somewhere that someone voluntarily took the test to provide it as bonafide evidence.

But like I said, moot point in your case.

Thats good to know!!! I think its enough evidence when they look at hubby's baby picture & Gisele's. They look like twins!

Nice article, Vivek. I get the part that the U.S. can't suddenly absorb an influx of wives and children but hey, why not let them come visit? Or come as dependents? Don't let them work or such but at least let families be together during the process. If non-immigrant temporary visa holders are allowed to bring dependents then it makes absolutely NO sense to not let LPRs have the same right.

This seems like cruel and unusual punishment to me.

Yes thats all that we ask for. Atleast give us the same rights as non-immigrants. We are not demanding Permanent resident status right away. My wife did apply for her visitor visa and she was denied because they assume she is a candiate to over stay her visa. Its all backwards.

There used be a visa catogory called "V Visa" which did allow you to bring your spouse to the U.S while she waited for her immigrant visa to be procssed. Unfortunately this visa sunsetted in 2000 I believe.

My local congressman did contact me after this article came out and he introduced a bill to resolve this. Unfortunately the politics of immigration reform are very complicated. They do not want to address any immigration related things individually. They want to do illegal and legal immigration reform at the same time.

Yes its total Rubbish.......I don't know why LPR's have to be punished for doing things the legal way. Here is a story about me that came in the newspapers when I was actively involved in changing this cruel law. I finally gave up.

http://press.americanfamiliesunited.org/2008/07/san-jose-mercury-news-green-card-and.html

WOW! Great article. Sad.. but great. US Immigration law is dumb. And, if anyone knows anything about its history, you will know that it has ALWAYS been dumb. Quota Act of 1924 ring a bell? Chinese Exclusion Act? Gentlemans Agreement? Henry Cabot Lodge and his DIRECT message to the President that we needed to curb all non- Northern European immigration for fear of bringing vagrants and slum tenants? Anyone ever read the uncensored version of Upton Sinclair's the Jungle? Home of opportunity? Whatever... Sick. I was born here. I have rarely seen moments where I was proud to be an American. When people hear me say that - they say - well then LEAVE to which I say.. GLADLY and WORKING ON IT. :) However I want to first pay back my wonderful government student loans first. :innocent:

Oh and... this whole immigration experience has hardened my soul even more so. This country is backward and greedy and growing more and more xenophobic every f'n day.

So I thought I would utilize my lunch to do something relaxing and went to my annual physical. Had appointment for 10:30.... At 11:00 I started feeling extremely ignored and felt like calling NVC and asking what the hold up is. At 11:10 the doctor picked in the room said hi to me, grabbed some brochure and left.... At 11:15 I WAS :angry::angry: so I picked out of the room holding a stupid napkin that I am supposed to wrap myself in but which looked like I've been wearing it for many days at that time, and tried to see if I am indeed invisible by yelling hello across the hall to receptionist...At 11:30 when I couldn't feel my legs and arms (the napkin does not provide much warmth) the doctor came in.....Nothing would work better to take my mind off NVC than this pleasant lunch

It was while reading about immigration laws (absolutely horrific!) in history class in high school that I first wanted to be an immigration lawyer. Help others through the process of gaining what I was given simply by virtue of where I was born and who I was born to.

But then I volunteered in a hospital (wanting to look good on future college applications) and fell in love with nursing. It was all downhill from there....
