I just got of the phone with our AWESOME, AMAZING case working in Frankfurt and he's moved our interview from May 3 to April 19!!!!!! With a little luck she'll make it back in time for our best man's wedding on the 24th!

I talked to the guy who prepares my taxes and he told me you do not have to file before the deadline if you're due a refund. The penalty for not filing is a percentage of the amount you owe, therefore, if you're due a refund there is no amount owed - hence no penalty. I backed it up by looking on the web..here's just one of the many answers I found:

If you’re among the majority of taxpayers who have a refund coming, you can ignore the April 17 deadline with impunity.

You see, the penalty for failing to meet the deadline is a percentage of the tax owed with your return. If you owe zero, the penalty is zero. Of course, you should file as soon as possible to get your money back. But there’s no reason to lose any sleep, miss any tax breaks or risk life and limb rushing to the post office by midnight April 17.

So I'm waiting until Merlaine gets here. If I file without her, I'll owe. If not, I'll get a refund.

YAY!!!!!! What a great jump! Is your evidence all ready? Will you be attending the interview with her?

No, I won't be going along. Our evidence is all in order, although our case worker told us that they have everything we would need. I told him we were planning on bringing some pictures and other evidence and he said that that's probably a good idea, and that it really depends on which CO we get as to whether they'll want to see any evidence or not. We both agreed it's better too bring too much, than too little.

She'll bring a copy of our DS-230 package, AOS package, photos, afidavits of our relationship, post cards and mailings between us, phone records (that will be a heavy stack of papers LOL), proof of her being on my insurance, and anything else she can think of that may help.

The AVR is still telling me that the NVC has reviewed my packet of documents and found missing or incomplete information, and it's said this since 04/01. I've called and spoken to a few different people, and they all pretty much say the same thing "mail was recieved on the 1st of april and is being reviewed"

I recieved a checklist email asking for my DS-230 on 04/04, which had already been sent.

I'm getting extremely frustrated at the operators lack of answers. Should I just keep calling, should I ask to speak to a supervisor, or is it just a matter of waiting?

Any suggestions would be appreciated.

Ok, so I need some advice/suggestions.

The AVR is still telling me that the NVC has reviewed my packet of documents and found missing or incomplete information, and it's said this since 04/01. I've called and spoken to a few different people, and they all pretty much say the same thing "mail was recieved on the 1st of april and is being reviewed"

I recieved a checklist email asking for my DS-230 on 04/04, which had already been sent.

I'm getting extremely frustrated at the operators lack of answers. Should I just keep calling, should I ask to speak to a supervisor, or is it just a matter of waiting?

Any suggestions would be appreciated.

Both the AVR and the opearators will keep saying that until the packet has been reviewed AND entered into the system. I'd so sit tight and wait a few more days. The more you call them, the more frustrated you are going to get.

It sounds like the False RFE a lot of us have received. Give them a few more days to process the DS-230. Maybe call back on Friday for any news?

If you have children, go ahead and file Head of Household first. If you spouse wasn't living with you for a single day from July 1, 2009 to December 31, 2009 and you provided more than half of the support of your child, then you qualify. Then, when your spouse gets here and has their SSN, you can file 1040X and amend your return to add your spouse. Of course, if it's more beneficial for you to file HOH than MFJ, you don't have to amend at all.

If you don't have children, file MFJ and include the ITIN application. I also remember Kevin saying something about not having to file by April 15 if you're due a refund. I don't think it sounds right, but Kevin will have the details on that.

My understanding is that everyone must filed by 4/15. If you can't file by that date, you must file an extension.

Totally sounds like false RFE - same thing happened to me b/c I sent AOS before DS-230 - the request for missing info was in response to DS-230. My false RFE was in regards to mail sent 3/31 and the AVR finally changed this morning - try calling again tomorrow!

That's not correct tharnsur. If you owe taxes then not only do you have to file by then, but you have to pay too, otherwise you'll start paying interest and penalties for the time you're late. Just type the question into google. You'll find the answer that I posted on the last page. "If I'm expecting a refund do I have to file before April 15th?"

That's what I learned in school, too, but I can see how what Kevin's tax guy says works, too. I sent an e-mail to my advisor asking her if she knows what's up.

To be fair, I've filed late returns for people where there haven't been penalties assessed. I just never thought of why that would happen. I'm trying to find my notes, but I'm pretty sure the virus ate them, too.

Not hating on Kevin, now. Just sparked my interest and now I have to know.
