RFE (Request For Evidence) NOTES from the LingChe guides:

Stay on top of your case during your stay in NVC so you catch an RFE as soon as it pops up.

IF YOU ARE NOT SURE THAT YOU HAVE AN RFE, USE CAUTION. The RFE advice below is under review. A VJ member has reported that they know of instances where sending in RFE information has delayed cases. We are waiting for specific information on these instances, and until such time we caution all users of the guide to use their best judgement in responding to a "possible RFE".

If you review your packages, you might even find an RFE before NVC does, and can send the correction at anytime.

When reviewing your package, it's helpful to know some common RFE as linked here as well as searching the forums.

If you are issued an RFE, send the required documents.

IF YOU CONFIRM WITH NVC THAT YOU HAVE AN RFE, DISREGARD THE WARNING ABOVE.:

--BARCODED cover sheet you printed from the website, but when addressing your package, change the Attention line from "ATTN: CMR" to "ATTN: DR"

--Your own Cover Sheet listing the documents you're sending and reason.

--Include the documents missing or corrected based on operator suggestion and your own common sense.

Address it to:

Regarding the AOS package:

First thing, I would recommend is that you print out the I-864 form and read the instructions about 2 times. Mark out the relevant portions and ask any questions you might have after that. I would suggest you read the guides for a comprehensive idea about how the AOS packet will comprise.

Recommended AOS package:

I-864 Coversheet (with barcode) for payment of $70

Form I-864 (signed and dated)

2009 Federal Tax Return/W2 and 1099s or IRS tax transcript.

2008 Federal Tax Return and W2 and 1099s or IRS tax transcript.

2007 Federal Tax Return/W2 and 1099s or IRS Tax Transcript

Letter of Employment

Pay stub(s) from the most recent six months

Bank Statements.

Remember, the USC petitioner will file a I-864 regardless of income. If your joint sponsor lives in the same household as the petitioner, then they will use I-864A. If they live in a separate residence, then they will fill in another I-864.

For your joint sponsor you will need proof of their citizenship/residency. For household member, you will need proof of relationship and same household/residence.

How on EARTH could you possibly get a RFE for the DS3032?

That's the choice of agent form? Did you not fill it out correctly?

Have you PAID your IV bill yet? Has it cleared? Does it show PAID? Then IGNORE whatever the heck they sent you for the DS3032.

Send that DS230 barcoded letter when you send in your IV package.

yeah i know right? :bonk:

we sent an email in the VJ template format (but he forgot to attach a file of the actual document..doh! )

BUT he ALSO sent a hard copy by mail. he also filled it out. it is possible he made a mistake. but this time i will fill it out for him. :hehe:

i am guessing that the document never made it to the NVC....probably. lost in the mail somewhere over the pacific...?:(

and yeah, i already paid the IV and AOS bills. im just waiting for the PCC to send in the IV stuff.

but what i got was a CHECKLIST letter for DS 3032. i assume that's the same thing as an RFE.

it also has the return address to send it to ATTN DR.

either way, at least DS 3032 isn't too much of a big deal.

i am mostly just wondering if i should send the IV to the CMR or the DR now....

Tokyo.Lovers--If you've already PAID the IV bill, and it has cleared and you have the barcoded cover sheet--then IGNORE whatever it is they sent for the DS3032.

Your DS3032 has been accepted without issues, otherwise your IV bill wouldn't NOT have generated in the first place. Understand?

Seriously. I got a barcoded email asking me to send in the AOS packet a DAY AFTER MY CASE COMPLETE.

so they are issuing tons of FALSE RFE's then? hmmm how troublesome!!!

and they sent out an email RFE AFTER you are done with them. that is too stressful!!

but thanks for the advice! (F)

i will also call the operator tomorrow just to make sure they get things straight there too.

I'm not saying this to be mean, folks, but it is IMPERATIVE that people UNDERSTAND the NVC steps and how to work it for any chance of quick success.

If you need help--ask for it. This isn't rocket science.

Read this till you can recite it in your sleep.

Petitioner: Get NVC # + give operator your email IDs + receive AOS fee bill + pay 70$ online + wait to show paid + print cover sheet + send I-864 AOS with all documents and case # written on each page.

Beneficiary: Get NVC# + receive DS3032 + send DS3032+ DS3032 accepted + IV fee bill available to be paid + pay & wait to show paid + print IV cover sheet + mail DS230 package with all original/certified documents

= wait for case complete + wait for interview to be scheduled.

IV to CMR. DS-3032 to DR. Yes?

Whatever the address on the barcode sheet says, send it there. We already know what fun NVC has with our mail. No reason to give them an excuse to play with it for an extra day or two.

..........

Can't sleep. I apparently missed the part where the nurse told me at 4 AM that Husby wasn't up on his Tdap. He'll have to make a return trip into the city and get jabbed again. He's not happy. So I feel bad because he depended on me to get that right and I missed it completely. I only caught it because he finally scanned a copy of the lab results to me. :big sigh: This happens every time we argue. I can't sleep, and he's distracted at work. I think I'll send him flowers to make him smile. Yes... my man likes flowers... It's one of the things that makes me go gaga over him.

When I sent mine there was talk in threads of an auto response email after emailing. So I panicked and rang NVC and was told that only comes in after the acceptance.
