Ok, folks. Let's try this AOS thing again--

--First, decide which 3 tax years you are going to use. ('09, '08, '07 OR '08, '07, '06).

--If you haven't filed for 2009 taxes yet, THIS would be the time to do so. Be almost guaranteed that they will be asked for at the interview.

--For question # 25, which is regarding tax information, write down those years and the corresponding amounts on your W-2s or the total income (adjusted gross income on IRS Form 1040EZ) as reported on your Federal tax returns.

--Now let's move to # 23 which is for annual individual current income. If you've been working at the same job, then just list the same amount as on your latest tax return (2008 or 2009, depending on what you're using).

--If you've changed jobs, or you have a new job, or your income has changed in anyway, then this figure will change too. Say you're earning $2000 a month, then your 2010 projected income will be $24,000 ($2,000 x 12). This MUST be backed up by employment letter or paystubs. If you're currently unemployed, then make sure you write $0.00. People have been RFEd for this.

I'm proceeding with #3 as of this moment. I've until April 20th or so which is when I'd have to submit my stuff to VFS. Hopefully my cousin will see reason by then. If not, we will have to go with my FIL's stuff. I'm keeping my options open.

Some people have private messaged me about what to enter for #23. Some have entered their year to date income in this box and wonder why their income is so low, and others have entered their 2009's income. While those people in the same line of work will have/should have similar figures as their 2009, the question does not ask what you earned in 2009. It varies from person to person.

If I might add, FILE YOUR TAX AS SOON AS POSSIBLE. If you are planning to call the IRS for a 2009 tax transcript, realize that it will take time for the IRS to enter everything into their system. So even if you were to file TODAY, it does not mean that the IRS will have a transcript ready for you right away. It may take several weeks for your return to be completely processed. Granted you can bring a copy of your return to the interview, but anytime you bring a return, you must also bring a copy of every W2, 1099, and every attachement with your return. This can be a mess of a headache.

Tax transcripts are much much easier and much much more credible than a copy of a tax return as it's PROOF that the IRS has received. Copies of tax returns really don't hold much water since anybody can print a fake tax return with fake income, and fake attachements. People that wonder why the NVC and embassy want all the evidence and attachments with copies of their tax return, it's because a tax return can be falsified.

I'm filing I-864. Right now, I have 2009, 2008, 2007 federal tax return transcripts and W2 for 2009. I also have pay stub(s) from the most recent six months as well as bank statements. I am making above the poverty line as well. So do I need the 1099s(?) and W2 from 2008 and 2007 as well?? Thanks.

I would - i sent in everything. all my 1099s (1099-G, 1099-INT etc). it does say you need to send in 1099s. Send in all your W2s from ALL years! DO NOT GIVE THEM A CHANCE FOR AN RFE! if you have the W2s (as you should), send in those copies. I sent them paystubs of the last 3 months (year to date), bank account statements (checking AND savings), online account snapshots, investment account snapshots (showing more cash there), employment letter stating your current position, salary, start date and standing (ie in good standing, full time etc ). even though i make well over the poverty line, seriously, dont give them a chance to come back to you and delay you any reason. i organized everyhting by year, tabbed everything, wrote my case # on top of EVERY page (right hand top). if you got it, send it! hope this helps...
