Also, keep in mind they will want the actual copy of filed return for 2009 at the interview (chances of this are VERY high) so make sure you have that together.

I used turbotax for 2009 tax. I assume what I print out from that would be sufficient, correct?

Make sure the amount of income listed matches your 2008 tax transcript, since thats the current year still, technically. That's what I did. I included my W2 for 2009, but didnt list that as my current income, 2008 instead. :thumbs:

I'm not sure if I'im understanding this. "amount of income listed"? is exactly what in the I-864 form? I assume that for question #18, which asks my current individual income, I would write down my current income ($/year), correct?

QUESTION CONCERNING AOS:

vivekjay (or anyone that can help) :help: ...I have a question about your #4 from your post.

So would I use my 2009 "total income"(from my 1040)for "#21. My current individual annual income".

...and use years 2009,2008&2007 "total income" (from my 1040)for "#25. Federal Income Tax Information".

This would make #21 & 25(line 1) exactly the same for my 2009 "total income".

I wanted to double check because I'm a teacher, and my letter from employer will state my salary from the school year 2009-2010...which wouldn't be equal to #21...and I would be submitting my 1040 with w-2s for 2009, and transcripts for 08-07.

Thanks for any input or corrections.

If I understand you correctly. YES Your employment letter is just to show current employment. Dont use that amount. The income information will be what your last filed tax return would show (or transcript) line 21.

Ok, I've been too embarassed to ask this question but I'm going to just ask anyway because I've searched and searched here on VJ and can't find any postings on it. I am using my 2007, 2008, and 2009 taxes for AOS. The problem is that I filed 07 and 08 late...like a week and a half ago. Back in November I had gone down to my local IRS office and asked for my tax transcripts and was given the W2's...only recently did I realize these were not the document that is being asked for in the I864 instructions. Had I realized I didn't actually have the transcripts, I obviously would have filed sooner...I just figured I had to send them in before I signed and sent in the I864 so I was focusing on all of the other paperwork. However, I believe I remember reading a post a while back where someone sent in their AOS package even though they had filed late but didn't wait for the late returns to process (i.e. to get the tax transcripts). Is that possible? Initially I thought that as long as it was all processed before the interview everything would be fine for the embassy but now I'm not so sure. They're telling me another 5-7 weeks before it's processed...could take less time, you never know, but still. Anyone done this or can you point me to posts about situations like this?

Yes. When it asks what your current individual income is, you would list your gross income as its listed on your 1040.

Line 21 on the 1040 tax form is designated for "other income". Should it not be line 22 which is "total income"? I am wondering myself.

On the I864 form, question 23, this is where you put your "current individual annual income" this amount should be identical to your most recently filed tax return, or the adjusted gross income you listed on your return. Question 24a will be identical to question 23.

Then yes, 2009! With me, I hadnt filed for 2009 yet. So I used the income listed on my 2008 tax return instead. (I still included a copy of my W2 for 2009 however.

If you provide a photocopy of your tax return(s), you mustinclude a copy of each and every FormW-2 and Form 1099that relates to your return(s). Do not include copies of theseForms if you provide an IRS transcript of your return(s) ratherthan a photocopy.

the past 3 years taxes are optional and only if you need them to support your case, so you do not even need to turn them in... You will need to have your 2009 taxes and you can use the actual forms from e-filing (the 1040 with the supporting documents) since the transcripts will not be ready.

I think we've addressed the issue of AOS many times. Folks, YOUR CURRENT INCOME or YOUR CURRENT HOUSEHOLD INCOME refers to your PROJECTED income for 2010. This is question #23 on your I 864. IN FACT, eligibility will be based on the PROJECTED income FOR 2010 and supporting documents.

Your 2009, 2008, 2007 tax returns are merely supporting documents ( strong evidence ) that you will and you can sustain the projected income. Of course, if you will be having the same job/work, then the evidence is self-relevent.

IF THIS AMOUNT DEVIATES GREATLY FROM YOUR most recently filed adjusted gross income year, be prepared to provide sufficient evidence ie..stubs, employment letter, etc..

Sachy, if I were you I would not worry about this at all. FOCUS on providing sufficient evidence that your husband will sustain his projected income for 2010 as this income ( the projected income ) will be used to evaluate visa eligibility. YOUR income proof, asset proof, tax transcripts and tax returns, and anything else serve only to provide support that the sponsor will sustain his projected income.

Regarding your cousin, do what you can but it's not necessary. Actually I would not base the sponsorship or conversation at the interview on the cousin but that of your husband's. ONLY IF THE CONSULAR hesistates or you sense a hesitation should you bring out, "Mr. Consular, I'm confident that my wife can support me BUT if you need another sponsor, here is my cousion's paperwork should you need it. S/he is willing to joint sponsor if necessary."

So don't present your cousin as a main sponsor but do so as a "if need be", your cousin can joint-sponsor. If you do this, you can pull whatever returns or transcripts you have from your cousin and show at the interview.

If at all possible, do not include the cousin as a joint sponsor unless asked for by the consular. I have heard many horror storoies of people that have had thier cousins pull the plug after entering the U.S. That's an even worse situation to be in because the sponsor or joint sponsor can retract their sponsorship anytime.
