This is actually a good thing to remember, everybody.

The NVC is NOT the authority when it come to the AOS. NVC only looks at your paperwork and organizes it before sending it to the consulate. The AOS is evaluated at the interview at the sole discretion of the CO. There have been instances where fully qualifed joint sponsors approved by NVC were rejected at the consulate level. For example, someone used an elderly grandparent with sizeable assets. The CO's concern was what if the 92 year grandmother were to kick the bucket tomorrow? Where would the AOS stand then -- who'd be responsible for the immigrant then?

The thing is, Raj, when our AOS went to NVC, the 2009 taxes were not included then.

Since our interview is in May, I am certain they will be asked for since the filing deadline is April 15. My joint sponsor, my cousin, is refusing to send them to me citing his privacy concerns regarding his confidential information. My FIL is willing to step in. So now I don't know what to do.

I'm not sure what happens if this yanking were to happen at the interview.

Sachi can your cousin mail in the 2009 tax returns directly to VFS if he is reluctant to give it to you for privacy concers? Just a thought. I have mixed feelings about throwing in a new co-sponer at the last minute but looks like people have done it before.

I know India is different. Who is it you have to send the documents too sachi? You send your stuff in ahead of the interview? Can you call them and ask their advice?

We have to submit our documents to VFS 10-15 days before the interview so that the CO has time to review the files before the interview.

Okay. So I basically have 3 options:

1)Submit my husband's I864 to VFS. And basically hope for the best. That he qualifies and the joint sponsor becomes irrelevant.

2)Submit my husband's I864 to VFS. If the issue of the JS arises during the interview, then I can provide my FIL's stuff. Which could possibly lead to AP if they don't review it right then and there.

3)Submit my husband's I864 to VFS along with my FIL's stuff and a note from my cousin. Which might lead to uncomfortable questioning at the interview. But hopefully, no AP since the stuff will already have been evaluated.

Okay, I'm taking a poll. Everyone please participate. Vote for option A,B,C.

Gah! Boys! Husby, after not picking up the phone several times, goes "Oh. That's nice. So... Uh... When's the interview?" in his regular voice. What the HECK?! This is a beg step, goshdangit!

I must say that I now feel relieved knowing that I was not the only one to received a stupid reaction from the spouse..hehehehe

3 looks like the best option sachi. Send everything you have and an explanation note from your cousin. Would he be comfortable faxing the info directly to them? Maybe have him state that in the note, "I would be willing to fax the documents to an officer there if necessary" or something to that affect?
