13-15?! Thats crazy!!!! wacko.gif But why India specifically? Did I miss something?! Thanks for the link will check it out. I guess Microsoft would be the way for him to go.

You know I am from Ukraine & I think its between 2-3 yrs to petition for a sibling. Actually maybe a little bit more. We came here in 91 & my sister joined us in 95 but since then I think I heard where other ppl came sooner.

Also why doesen't India offer where you can win a greencard like other countries do?

There is quota of 65000/year for brothers and sisters of USC. On top of that there is limit of 7% per country........ So that comes close to 4500 Green cards/Year. There are lots of applicants from India so its severly backlogged. I might be off a little bit on the country quota.

Since there are already so many applicants from India ...... Indians are not eligible for the diversity lottery.

No documents lost. Thank you, Lord.

What about getting a certified copy from that country's embassy in the US? Or a report of marriage? Is it possible? That way you have something to keep when you send in the original certificate.

It's things like this that make me happy Thailand issues two original marriage certificates at the time of marriage.

Also why doesen't India offer where you can win a greencard like other countries do?

Simply put there is already too many Indians in the US...Any country that has sent more then 50K immigrants in the last fives year is not eligible. The DV visa was crated to increase the number of underrepresented minority in the US, also to not have any backlash from the international community about the US immigration policies. DV is seen as a “fair” policy.

Congress has a limit on how many visas can be issued:

Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320.

Section 203 of the INA prescribes preference classes for allotment of immigrant visas as follows: FAMILY-SPONSORED PREFERENCES

First: Unmarried Sons and Daughters of Citizens: 23,400 plus any numbers not required for fourth preference.

Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent

Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:

A. Spouses and Children: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;

B. Unmarried Sons and Daughters (21 years of age or older): 23% of the overall second preference limitation.

Third: Married Sons and Daughters of Citizens: 23,400, plus any numbers not required by first and second preferences.

Fourth: Brothers and Sisters of Adult Citizens: 65,000, plus any numbers not required by first three preferences.

So if all the people above total 50K then your country can not be in the DV program.

Question: I'm working on sending in the DS230 paperwork and I only have one Marriage Certificate and can't get a certified copy at this time (we were married in another country and neither of us is there). Has anyone had their original documents lost (personally) and does anyone have any tips?

We only had one original marriage certificate too. Just make sure that you put in an additional set of copies with your package so that way they will give you back the original at the interview. Plus make 2 extra sets. 1 for you and 1 for your SO...make sure you take 1 set of copies to the interview just in case it was "mislaid" somewhere!!good.gif
