Not sure what you are needing advice on... What to do as far as the 864?? You will still need to file, attach a letter stating that you are not required to file taxes and the reason you are not required to file and get yourself a co-sponsor for the financials who will fill out an 864 and the supporting financial evidence.

Agree with post above. Additionally, if you did not file for TY 2007, you may want to file late as you probably qualified for a Recovery Rebate payment of $300 to $600. At least worth looking into.

When you prepare the I-864 - include those.

Strongly suggest you go to a CPA, have an 'audited income statement' prepared for the last 3 years - should be no more than 2 hours of billable time. Include that with the I-864. Sure, it's a PITA, but most folk at NVC are NOT trained to look for 'non-W2 income'. A Statement from the CPA usually trumps all other stupidity.

NOTE: Typical proof that a sponsor was not required to file a tax return for a particular year would consist of a written statement from the sponsor, signed under penalty of perjury, attesting to the amount of his or her income for the relevant year and to the fact that a tax return was not required by law. USCIS adjudicators handling form I-864 issues should be aware of the income threshold for the requirement of filing a tax return for the last several years, so that an RFE for evidence of the law is not necessary. In particular, the instruction booklets for each years forms 1040, 1040A, 1040EZ specify thre income threshold below of which a person is not required to file a return

If you receive disability payments from the VA you will not get a 1099 or a W2. You should have an award letter from the VA stating your monthly disability payment. If you don't have it you can request one from the VA.

the 1099 referance was for persons collecting social security disability insurance payments, where you do get a 1099, thanks for the VA information
