What guide to use to bring your spuse?

Hi!

My wife´s mother (a us citizen) just married her husband from El salvador. For her to bring him here, for her to make it possible for him to LIVE here with her...

Dont know if either is correct. cause it for example asks for proof of joint things...which they dont have..i mean they live different countries so :S

she does not want him to come on visa and wait for being approved, she wants him to come when his paper and all is done. so which form would be best?

Follow the I-130 guide. K3 is obsolete. You better look into CR1/IR1 visa forum.

He would be coming on a visa and would have to wait for an approval before coming, no matter what. Your MIL would have to file an I-130 petition w/ USCIS, wait for that to be approved after which her husband wold have a visa interview at the consulate in the country in which he resides. Once the spousal visa is approved and issued to him, he can enter the US. After US entry (in about 2 weeks) he will receive his greencard...which depending on the length of the marriage will be a 2 year conditional green-card (conditions will have to be removed via petition once the marriage reaches 2 years) or a 10 year green-card (if they have been married longer than 2 years when he comes to the US.
