Hi

just to be sure that we can understand you well.

In her passport there is a valid tourist visa B1 B2, with multiple entrys valid for several years and when she arrived they gave her a legal time to stay at US for 3 or 6 month in the I-94 form. I ask you because for me is not clear what kind of visitor visa is? If i am right, i think it is a tourist visa B2 ( but as far as i know people from most of european countries dont need a tourist visa so they get a waiver valid for 3 month).

If this is like i said, is very important to contact a lawyer because she has been illegally in the USA since her i-94 had expired. Is not clear if she has asked for an extent of validity period of the i-94.

Yes in her passport there is a valid tourist visa B1 B2. She has an I-94 form and an exension form taking it to June of 2002. So since her I-94 is expired I should contact a lawyer?

Your case is as straight forward as it gets. No, you don't need a lawyer, absolutely not. The only thing I urge you to do is make sure you fill out all of the documents with the utmost care to detail. Take it seriously.

You will file the I-130, I-485, and 1-765 concurrently. Your wife's son is a US citizen, so he has nothing, zero, nada, to do with immigration on any level. Forget him.

In a few months, you'll be getting an appointment for an interview. The I.O. will ask question regarding your relationship, basically make sure the marriage is "real." There will be no questions regarding the overstay. It's a non-issue. What they like to see is photos of the wedding and reception. Probably a good idea to make an album. For me that was 95% of the approval.

Great!! Here is another question I have been filing out all the paperwork and getting all the supporting documents together. How should I put all of them together? Should they be stapled or should they be bound in a 3 ring binder? Thanks.

Short version: don't send too much stuff with the application. Don't drown them in "stuff." Take the supporting documents with you to the interview, any way you think it looks good.

Each form (I-130, I-485 in this case) requires its own supporting documents/evidence - while you may be filing them concurrently, they're evaluated separately and you should assume different people will be looking at each one.

So that means 3 photos. Follow the Assembling the ____ Checklists for each form in the Guide.
