Hi to all;

If I will file the 90 days temporary work permit upon arrival in the USA, do I need to pay the $340 for the filing fee or I will I be exepted from paying such amount since I just got in the US?

You will need to pay if you are filing before AOS, and I can tell you its pretty much a waste anyway, as it takes 60-90 days to process it and its only good until your I-94 expires, so even if you send for it the day you get into the country and you get it approved in the 60ish days that are average right now, you will only have it in your hands for about 2 weeks before it expires. I would just get your AOS filed as soon as possible so you dont have the extra fee and so that its good for longer once you get it.

Hi to all;

If you file for the EAD (I-765) immediately on arrival WITHOUT filing AOS then yes, you will need to pay the filing fee. The card will only be valid until your I-94 expires which is 90 days after you arrive, and typically the card will take around 60 days (as stated, and sometimes longer) so you won't be able to use it immediately either and it will be valid for a short time. A waste of money in my opinion.

As stated if you marry and file AOS immediately then you will receive the EAD in around 60-90 days and it will be valid for a while and then will be taken over by your greencard and then your greencard is valid for 2 years until you file for AOS.

Up to you of course but I wouldn't waste the $340 if you're already having financial trouble and unable to afford the AOS (which is some people consider the EAD before AOS), it would be a complete waste of money unless you get a job that pays $500 minimum a week so that for the entire time the card is valid you earn enough to file for AOS... bearing in mind that it might not even be valid for 2 weeks, that's just a guess. Most of the time just K3 visa applicants get the EAD because they have 2 years from entry to AOS.

Should have done this earlier...

** moving from "Adjustment of Status Case Filing and Progress Reports" to "Working & Travelling Prior to Getting a Greencard" as this is relating to working prior to getting your GC**
