Hey guys,

quick question,

My husband is the in the dominican republic and i am putting together all this paperwork.

Currently, I am filling out the i 864 but I dont meet the requirements. I asked my sister to help me out. She agreed and will be filling out the I 864a. I live in the same house with my sister and her 3 year old daughter. Right now, us three live in a house. What do I put for household size? Do I include the daughter ( my sister claimed her on her tax form) Would the household size be 4: my husband the beneficiary, myself, my sister, her daughter? If so, where on the i 864 do I indicate her daughter on question 21?

Your sister's household size would be three if she just filed an I-864 as joint sponsor. If you have her use the I-864a, you'll combine income and have a household of 4.

You haven't indicated whether you're combining income and having your sister provide the I-864a as a household member or having her be a joint sponsor using the I-864.

Do you NEED to combine incomes to qualify or can your sister qualify for three on her own?

You haven't indicated whether you're combining income and having your sister provide the I-864a as a household member or having her be a joint sponsor using the I-864.

Do you NEED to combine incomes to qualify or can your sister qualify for three on her own?

What Pushbrk is saying is, there are two situations, one is that you and your sister are a single household or she is her own household and you are yours, if you are combining your incomes together to meet the requirement then your household will be you, your sister, her daughter, and your husband. You will fill out a I-864 and your sister will fill out an I-864A.

If you are filing with seperate households and using your sister as a co-sponsor you will fill out the I-864 with a household of 2 (you and your husband) and your sister will fill out an I-864 with a household of 3 (her, her daughter and your husband) as co-sponsor with the income of 125% above the poverty level for a household of 3

Its only a matter of if your sister has the income to qualify as co-sponsor alone or if the two of you need to combine incomes.

Hope this clears things up a little bit for you.

9 FAM 40.41 N5.2 Defining "Sponsor"

(CT:VISA-1126; 12-03-2008)

a. To qualify as a sponsor, an individual must be a natural person (not a

corporation or other business entity) who:

(1) Is a citizen, national, or lawful permanent resident (LPR) of the

United States (including conditional residents);

(2) Is at least 18 years of age;

(3) Filed the petition which forms the basis for the visa application (or

has a substantial interest in the entity which filed the petition); and

(4) Is domiciled in any of the 50 States of the United States, the

District of Columbia, or any territory or possession of the United

States. (See 9 FAM 40.41 N6.)

9 FAM 40.41 N7.2 Use of Form I-864-A, Contract

Between Sponsor and Household Member

(CT:VISA-911; 11-02-2007)

a. If a sponsor's individual income meets or exceeds the required level of

the Poverty Guidelines, no other evidence is necessary. In cases in which

the sponsor's individual income is insufficient, however, a Form I-864-A,

Contract between Sponsor and Household Member, must be submitted by

any household member who is willing for his or her income to be used by

the sponsor to meet the guidelines. The primary sponsor must include

the names of these individuals and their contributions on his or her Form

I-864, Affidavit of Support under Section 213A of the Act.

b. Under Form I-864-A, the household member agrees to provide as much

financial assistance as may be necessary to enable the sponsor to

maintain the sponsored immigrant(s) at the required annual income level.

The household member will be legally liable for any reimbursement

obligations that the sponsor may incur.

c. A joint sponsor is jointly and severally liable with petitioning sponsor and

any household members who have signed a Form I-864-A. He or she

must individually meet the minimum income requirements as set forth

above. Anyone outside the petitioner's household may be considered a

joint sponsor. Joint sponsors may include the income and assets of

members of their own household and dependents to meet the income

requirement.

i'm preparing my self ahead by filling out the form I-864. i have a question

i'm currently unemployed(college grad) living with my family. my other brother who's married lives with his wife separately is going to be my joint sponsor.

on form I-864 part 5 question 21 a, c and g. i have to put 1. total members 3? i don't have children.

should i leave part 6 and rest of the below info blank since i dont have income nor asset

IR-1 / CR-1 Visa

2010-04-19: approved online wohoooo

2010-04-24: NOA2 hardcopy received

2010-04-26: gave 2 email addresses and assigned case #

2010-04-27: received/sent ds3032, AOS bill

2010-05-01: IV bill became available online/paid

2010-05-06: sent in DS230 package via express mail 9:07am

2010-05-11: NVC acknowledges the receipt of AOS on 05/05

2010-05-13: operator told me that AOS sent to supervisor for review....

2010-05-14: AVR changes to received the checklist letter response on 5/13

2010-05-23: RFE for original birth cert. (i did sent original).......arghhh

2010-05-24: BC under review by some department

2010-06-02: sent in original BC again and previous BC is still under review

2010-06-10: NVC recognizes BC into their system

2010-06-15: BC under review

2010-06-21: SIF!!!!!omggggg soo happy 57 days in NVC process

2010-06-28: interview on Aug. 19, 8am.

2010-08-19: interview went fine but he's put into AP :(

2011-01-09: almost 5 months in AP "still pending"

2011-02-06: 5 and half months and still counting......when is this torture going to end....

2011-02-20: 6 months still no answer..........

2011-03-08: more than 200 days passed in AP..................(

2011-03-24: visa has been issued today. hurayyyyyyyyyy finally wait is overrrr.

Hi everyone - can someone help?

I have a problem - my interview is scheduled for April 14th and I understand that you have to bring the latest tax return from your sponsor and co-sponsor (which we have). The problem is that last year was a horrible year for my husband and co-sponsor as California was hit very badly during the recession. I don't know what to do as I'm afraid they will say that we don't have enough financial support.

Can anyone suggest what can be done aside from getting a third sponsor and do you need to present the actual Tax Return or just a copy of the W2's or 1099's?

Can I confirm from someone that 2009 poverty guidelines for a household of four in California is $27,563?
