Russian fiancee, U.S. born child and K1 visa

Hey everyone,

I am hoping to find someone out there that has gone through what I am. My fiancee

is from Russia, her son was born in the U.S. We have successfully petitioned for

a K1 visa. Soon, my fiancee will go to Moscow for her interview. With that said,

I have a few questions hoping to get answers...

1, Do I include her son on the DS-156 and 156K ...he has a U.S. passport and was

born in the U.S. but has lived in Russia all but 8 months of his 2+ years??

2. If I do include him on the forms, will he have to have a medical exam along

with my fiancee? Also will my fiancee be charged application fees for both

her and her son or just herself???

Any help is greatly appreciated, especially if your fiancee is Russian and she

has a U.S. born child.

A USC only needs their US Passport to travel freely about and back into the US.

He is outside of the entire visa process therefore should be listed on the DS-156 but you are not petitioning for a K-2 visa for him because he doesn't need it, therefore do not list him on the DS-156K. Also no medical required because again, he is outside of the visa process. He doesn't need a visa, he has the US Passport.

Her son is a US citizen and does not need to apply for a visa. He has a US passport at that is all he will need.

You can meet them at either place...up to you. Your presence at the POE is not required.

One thing to remember is that if her son will be living with you (I assume he will if he is 2), then he will need to be included in household size on I-864, during AOS (just like any other dependents would be). Other than that, as has been said, he doesn't need a visa so you don't have to include him in the visa process.
