My wife had to leave to go back to Brazil for a medical emergency. we were in the process of preparing paperwork to send to for her adjustment of staus but i am an accountant and i was so busy that we couldn't fiunish. My question is how do i show proof of an ongoing relationship? She has a social security card and the house is in my name. we didn't have bank accounts yet or insurance or anything yet. we were in the process of getting that stuff together but like i said i am so busy i work 7 days a week. i am writing this at 3:30 in the morning here. Please explain what is needed to do here?

Did your wife apply for emergency AP before she left? If not, you will need to start from the beginning with a CR-1 spousal visa.

No my wife just left on a emergency. What is the difference between the Marriage Visa and a cr1 spousal Visa

Unfortunately, as she just left, she cannot come back until she has a new visa, so you will need to start the process again, this time with a spousal visa (the CR-1 is the marriage visa, there is no difference). The good news is that she will get a green card immediately upon her return to the USA. How long the process takes depends on where you live and where she is from, but is around the same length as the K-1 visa you originally filed for. You can use the same bonafide evidence, plus the extra stuff you have accumulated since then, (photos from the wedding etc).

The Guides on VJ are very useful, so start here:

Sorry to hear about your situation.

Note that you are not required to submit evidence of an ongoing relationship when filing the I-130. It is not even "required" for the interview, but is highly suggested. Since the goal is to get your wife home as soon as possible, simplify things and submit only the required documents so the ball gets rolling. You can get the other stuff together during the wait. Also, keep in mind that the interview for the spousal visa will be in Brazil.

Biometrics 04/28/2010 (assigned appt. date is 5/17/10, but we did an early walk-in with no problems!)

I-485 Interview 09/13/2010 (originally set for July, but had to reschedule, since we were in Europe then)

Waiting on GC to come in the mail!!!
