Hello VJ!

MY husband and i filed for our aos on the 8th of March they received it on the 12th. our 3 months date from the time my fiancé arrived was on March 15th.

we filed the I-485, the I-131 and the I-765 also the Affidavit if support with all supporting evidence.

today March 20th we received our whole package back with rejection notice I-797C on all 3 I-485, I-131 and I-765...we mailed in EVERYTHING on the checklists..my close friend on VJ even sent me a copy of her cover letter to make sure we had everything.

we had the Medical transcription, 6 correct size photos, the check exactly made out for $1,010.00 to the U.S. Department of Homeland Security Citizenship and Immigration.

The I-797c's attached to the 3 forms ( I-485, I-131 and I-765)

the I-485 one said this...

The application/petition yiu filed along with any fee you submitted is being return to you for the following..

X Your application or petition is rejected becasue it does not contain a valid signature block of the application. A signature of the person prepairing the form if other than above block is not valid for this purpose.

(((((( we forgot to sign the I-485...so basically we should sign it at resubmit it)

not the other I-797c are identical to each other and read like this

the application is being returned to you with the fee for the following..

The principle application could not be accepted to the reasons specified on the related notice of action. therefore the processing of all riding applications cannot continue...

what does this mean YOu application was submitted with a single remittance and or more of the applications were unacceptable in the package for the reason specified on the related notice of action.. please correct the flawed applications and resubmit the package with the fees and supporting documents.

So basically the reason we got it back was my husband did not sign the I-485 and the I-131 and I-765 could not be continued to process without the I-485 so they sent in all back and just put on the two other I797c or is there also a problem on the I-131 and I-765..since it does not give reason.??

we are filing out a new I-485 and singing that one :) and should i leave the packgage the way the USCIS stapled it together or take it all apart and put it in order of how the cover sheet goes?

Just sign the I-485, put it back in the envelope with a copy of the notice you received, and mail it back. I don't think you need to do a new form...maybe just a post it note by the signature showing you have done it.

Just sign the I-485, put it back in the envelope with a copy of the notice you received, and mail it back. I don't think you need to do a new form...maybe just a post it note by the signature showing you have done it.

Yes - the other things were rejected because they were dependent on the I-485.

I would take it all apart and put it all back together again - the way you did originally. When you do send everything back in - you're not responding to an RFE, because you did not get an RFE, your package was rejected (as if it was never sent before).

Single check/payment. It relates to the fee - because they didn't take the I-485 (not something to worry about really).

What is a single remittance mean?

Yes. They cannot process the I-765 without the accompanying I-485. For starters, the fee would be different, as would be the category of eligibility listed on the form. I also don't think they can process the I-131 at all without the accompanying I-485, as without a pending AOS application you have no grounds to even apply for an AP document.

Since it's obvious that even if you put it back in order they'll just scramble it again when they get it, I would just send it back as you received it. It would be a good idea to add a new cover letter, in addition to the previous cover letter (if you included one initially, and if they sent it back to you) acknowledging the error, and explaining clearly how you corrected it.

Remittance means "the act of sending something to them". You "remitted" your forms to them, so the act of sending in your forms is a "remittance".

"Single remittance", in this context, just means that you sent in all three forms as a single packet (which is normal and proper during an AOS application). It means the forms are linked in their system, which they are, and that is why they also sent back the I-765 and I-131 in response to the problem with the I-485.

so if this is the case does this mean my husband is now hear illigaly since he is over the 90days? or since it was sent back to us make a difference? should we worry or anything?

Just send everything back as soon as possible - once they get it (and accept it) his status will be 'pending.' Noting to be terribly concerned about - you're going to be sending that back out on the first available opportunity right? :thumbs:

Re: reordering it, as it is technically a new application:

Hmmm, that's a good point. It certainly won't hurt to reorganize it to how it was when you sent in in the first time.

This, incidentally, is one of the reasons why it's a good idea to make at least 1, ideally 2 or more backup copies of your entire packet - so that correcting an error and resending is a simple operation.

Yes, technically he is out of status if the expiration date on his I-94 has expired, and the AOS packet has not yet been accepted. Don't panic. Just send the packet back in as quickly as possible, keep a copy of the rejection notice with you (this will prove, or at least suggest to a CBP officer, if you happen to run into one, that an AOS application is, in fact, in progress), and try to stay away from national borders, ocean ports, international airports, or any other places that immigration officers are known to congregate. Trying to avoid interacting with federal law enforcement in general (a sound policy at any time) is an especially good idea right now :)

A few out-of-status days are not that big a deal. It's when they turn into multiple out-of-status months that things start getting more complicated. Refile the AOS packet as soon as possible, and don't worry too much about it.

Sounds good we will correct the mistakes and add the new info in the updated cover letter. look through everything thing again and re organize it and send it out ASAP!

If you see my timeline, you'll notice the resubmission. I sent my AOS application in in December, and then due to the address error I made, it got rejected. I initially put my Canadian address (don't ask me why... please). The rejection letter said either I have to file it from outside the U.S., or update the address and resubmit, which I did. Thank goodness, my brother forwarded the returned application to me here. Like you mentioned, when I opened it, it was not the way I submitted either. Everything was out of order... So, what I did was 1. corrected the address on the application, 2. retyped all the cover letters, and 3. put them all in order the way I submitted first time around. Cheers.

Yes! I am approved!!! :)

It took only two (2) months to be approved. Hooray!

December 5, 2009 - I-485 application was submitted.

January 12, 2010 - I-485 application was re-submitted due to address error.

January 20, 2010 - I-485 application receipt notice arrived.

January 25, 2010 - Biometrics notice arrived.

February 9, 2010 - Biometrics taken at local USCIS office.

March 5, 2010 - Initial Interview notice arrived.

April 15, 2010 - Employment Authorization Card arrived out of blue.

April 29, 2010 - Initial Interview scheduled and... APPROVED!!! :) Conditional GC will arrive in 2-3 weeks.

April 30, 2010 - SSN reactivated. Newly printed card will arrive in 3-5 days.

May 7, 2010 - Welcome Notice arrived! Hooray! :)

May 8, 2010 - Freshly printed SSN card arrived.

May 26, 2010 - Conditional GC issued.

June 1, 2010 - Conditional GC ARRIVED! Yippee! :)

June 2, 2010 - SSN upgraded. Newly printed card will arrive in a week.

June 9, 2010 - Freshly printed SSN arrived.

October 10, 2011 - I-751 petition was submitted.

October 18, 2011 - I-751 petition was returned. It turned out to be USCIS's error sending it back to me.

October 19, 2011 - I-751 petition was re-submitted.

October 26, 2011 - I-751 petition receipt notice arrived.

November 18, 2011 - Biometrics taken at local USCIS office.

December 27, 2011 - I-751 petition Approval letter was issued.

December 28, 2011 - I-751 petition Approval letter arrived

Hello Everyone!

Once again Thank you for those who read this topic and who replied with wonderful help!

I just finished putting the whole packet back together again in the correct order.

retyped my cover letter

copied the rejection notices

placed the check in a new envelope

SIGNED THE I-485 :)

so we are sending it out tomorrow with next day delivery!
