Hello everyone,

I am completely new to this entire process so please be patient with me.

I am a U.S. citizen currently residing in the United States.

My wife is a Canadian citizen (we got married in March, 2010 in the United States) who is also residing in the U.S. (in a different state) on a B1 visitor visa.

Like myself, she is a foreign medical student (thus the reason for the B1 rather than student visa) and rotating at various hospitals in the U.S.

She has been in the U.S. for over a year and her visa will not expire until later on this year.

We would like to apply for a green card.

I would truly appreciate any advice/guidance/tips.

So far, these are the forms I have:

1) i-130

2) g-325 (for me and her)

3) i-485

4) i-693

5) i-765

6) i-864

Are these all the forms I need or is there something missing?

Also, just some general information.

a) It's not feasible to live together because we're both medical students and are required to rotate at different hospital in different states, but we are planning on moving in together this coming August. Will this affect our interview process and make things difficult to prove the marriage?

b) I have copies of the marriage certificate, pictures from the wedding ceremony, receipt of the engagement ring, cellphone bills, etc

c) we have never been able to live together because of circumstances such as medical school but I visit her often and can provide flight information, etc.

Please let me know if there's anything I am missing.

prove the marriage is important for you because you just got married.my suggestion is you can file I-130 first, then you can file i-485 & i-765 after you have been approved for your i-130.

Anyhow, fastplz, you stated that I need to prove the marriage is important to me. Can you extrapolate on that? Like bank accounts, joint property, etc?

Also, will it hurt if i sent the other forms along with i-130 or wait till i-130 is approved? I was planning on doing all the paperwork and sending it once all together.

Is this marriage first marriage for both of you and your wife? please do more research before you make a decsion. I did many research before i sent package.in your case your wife does not have to get GC in hurry, why not give little more time? Concurrent filing I-130, I-485, I-765 & I-131 should be ok if you can prove the marriage.

Yes this is the first marriage for both of us. We have never been married before, divorced, etc.

The reason why I want to expedite the process is because we are both medical student who will be applying for Medical Residency programs this September. If she has a green card, she has a MUCH higher chance of matching into a residency programs. Hospitals do not like to issue J1 visas if they don't have to, it's an extra headache.

as for tips - I would make sure you have a lot of proof of a bonafied marriage.. Im not saying it will happen but if something did happen and they desided to deny your petition then you have no options - you can't challenge a denial based on a B1 visa.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Do not apply J1 visa if you are going to apply AOS. Do not leave the country until your wife get AP.you can concurrent filing I-130, I-485, I-765 & I-131 if you can prove your marriage.your wife can get EAD(i-765) very soon if you apply for AOS.Do more research...

Hi and welcome,

This is the guide you want to read: Step-by-Step Guide on How to File an I-130 for a Spouse Inside the US

As someone mentioned, once you have filed, ensure your wife does not leave the U.S. When you file you have the option of also filing for an Advance Parole document (AP) this will allow her to leave and re-enter the U.S. while your application is pending.
