I am a UK citizen and my Husband is a US citizen. we married 18months ago now whilst he was in prison, he is still in prison and is due for release in 2012. I still live in the UK.

Is there anyway he can file for a k-3 whilst he is still incarcerated if his parents sponsor me?

please anyone with advise, greatly appreciated.

You're husband will have to sponsor you, not his parents

He will need to petition for you to come to the US.

PM HisGirl - she just had a visa issued while her husband was incarcerated

April 29, 2013 - NOA1 for petition received

September 10, 2013 Interview - decision could not be made.

April 15, 2014 APPROVED. Wait for oath ceremony

Waited...

September 29, 2015 - sent letter to senator.

October 16, 2015 - US Citizen

K3 is dead. You would take the CR1 visa path. Your husband is primary sponsor and a parent, not parents can act as joint sponsor. Start by studying the CR1 visa guide.
