Hey guys,

I would really appreciate it if someone could answer a few questions for me as I'm a little confused.

I have lived in the US (born in UK, married US wife) for 1 year and 9 months now. I arrived on a DCF (I-551) and am about to process an I-751 to remove my 2 year conditions. Once these are removed can I sponsor my sister (and her family) to live in the US? - My sister, husband and 4 children want to move to the US with me. If so, what is the process (I-130?) and time lines? Or do I have to wait for my I-400 to be processed and approved in 15 months time?

I have searched the forums and can only find http://www.visajourney.com/content/child and http://www.uscis.gov/files/article/B1.pdf under http://www.visajourney.com/forums/topic/314-immigration-guides-for-foreign-relatives/ I am confused as these only talk about sponsoring your child or husband/wife. What about brothers and sisters? Do you use the same forms and process?

What are the processing times for this? I have read anywhere from 1 - 23 years so I am really confused.

My eldest niece is currently 15. I know that if they reach 21 that makes them an adult. If this process takes that long, can I still bring her to the US?

Many thanks,

Mikiek

You have to be a US citizen in order to sponsor your sister and her family. Form i130 will used and only have to file for your sister. The family will be her derivative beneficiaries. And yes, 10 to 12 yrs I think is waiting time for her country of residence but not sure.some, like in The Philippines it's 23 yrs

Great - thanks for the reply...

Does anyone know what the UK timelines are?

Mikiek

Same as any other country with exception of Phillipines, Mexico.

10 years.

Look at the F4 category on the visa bulletin: http://www.travel.state.gov/visa/frvi/bulletin/bulletin_4747.html

ROC 2009
Naturalization 2010

You have to wait till you become a USC in order to petition for your sister.

I'm not sure if CR-1s have derivative status, but you should look into that.

You can check out the visa bulletin for priority dates. That'll give you an idea regarding the timeline.
