Am I correct in the forms I need to fill out?

So after being confused for a while and probably driving people on here nuts lol (sorry about all the questions) I want people if they dont mind to clarify I have this correct. Im currently on an f-1 student visa so Firstly, after me and my fiance are married I file for an i-130, i-485, and i-765, and take the medical. I also have to file for a affidavite. A couple of questions I still have is can your affidavite be your husband? I pressume so, but if so what if you dont meet the salary requirements? my fiance is currently working full time but will be starting school at the end of august meaning he will only be working part time by the time we get married and may not meet the salary requirements so what happens then!? Also, I just want to clarify that I qualify for the i-765. I have never worked here. I mean on a student visa you are not allowed to unless its on campus or something to do with your studies, but i still have not worked here in the full two years ive been here. Does this matter? or can I still apply for work authorization? Also, i have heard you have to have a social security when getting married in some states. Obviously I dont have one because im on a student visa and have never worked. This might be a problem? Also, someone told me that when you file for all of this you are no longer considered an f-1 student holder because you are trying to Adjust your status. So does this mean you are allowed to stay in the country being out of status because you are waiting for a pending AOS? Also, what happens if im still in school at this time? As Im not longer considered an f-1 student do I notify them that I am no longer and need to change it over because I got married or what? how does this work?

Lastly, has anyone had any luck with infopass? I mean i was considering booking an appointment with them to ask them exactly what I need to do, but some people on here have said there a waste of time?

Yes, your husband can be your sponsor. My Sponsor is my husband because he makes sufficient money, above the poverty line. If you do not meet the requirements than you will need to get a co-sponsor along with your husband to both do the Affidavit of Support

This all depends on when you guys plan to file- if you were to file this year, his tax return would lets say if it is enough, would be sufficient, if he goes part-time this summer, then you guys may need a co-sponsor

You can apply for I-765 along with AOS documents...

Check with your department of state or clerk's office to see what are the requrements needed for marriage. We got married in Delaware, no SSN because F-1 also.

YES... But change what over? you are not yet a permanent resident... but do let your DSO know you will be completing AOS

Well if as soon as I file for an aos I'm out of status and no longer on an f-1 student visa then what is my status while waiting for it to be processed?

I see, thankyou. So if I'm still in school and when I apply for my aos my f-1 visa is out of status then when I apply for. Classes do I notify them I'm no longer on a student visa?

Speak to your DSO who will let you know how to go about your classes... but do stay in status (continue classes) until the end of the semester or until you file the AOS
