Hi all,

I was wondering if anyone had any insight about whether it's possible for a K-1 petitioner to get a guest visa to visit the U.S. I'd especially appreciate if anyone who's tried this could let me know if it works. We submitted all our paperwork in June, and are pretty bummed about how long it is going to take. We were hoping to meet up during Christmas/New Year, but I think it will be too hard for me to get away from work. Is there any possibility that they will let my fiancee come from Moscow to visit, even though we have already started the K-1 process? Thanks!

May 2006 - began collecting documents and info

June 5, 2006 - mailed documents to USCIS

June 26, 2006 - CSC received our K-1 packet

June 29, 2006 - received NOA 1

September 13, 2006 - touched, after over three months of nothing!!

September 15, 2006 - CSC sends RFE

September 17, 2006 - touched!

September 20, 2006 - received IMBRA RFE and mailed it back to CSC

September 26, 2006 - CSC received and logged our RFE

September 27, 2006 - touched!

September 29, 2006 - touched!

October 1, 2006 - touched! something will happen soon, right?

October 5, 2006 - approved!!!

January 18, 2007 - Interview at Moscow Embassy

January 23, 2007 - recieved passport with visa

February 2, 2007 - fiancee arrives in US!!!

February 23, 2007 - civil marriage ceremony!!!! :)

Whereas there is a chance that she might be able to visit you, the fact that you guys have applied for a K1 would likely rise a red flag, not only at POE but also at the U.S. embassy in Moscow when she applies for a - I'm guessing - tourist visa?

I've read in another thread (I think the post was written by novotul), that it is extremely hard for Russian women to get visas to the U.S. In any case, she'd have to show proof of strong ties to Russia (steady job, leas agreement, real estate, anything that shows she doesn't have an intention to immigrate) to get a visa. In that line of thought, I guess the K1 would not seen as a good sign.

Maybe other VJs will be able to help you with more info on this one.

I only offer advice - not even legal. Just the plain and simple kind.

zhenik,

Point of clarification: a K-1 petitioner must be a US citizen, and so would not need a visa of any type to visit the USA (if they're not already living here).

Russia does not participate in the reciprocal Visa Waiver Progam that the UK does. So anyone coming for a visit to the US would need the proper entry visa before getting on a plane and arriving here.

Its heartwarming to hear that since my boyfriend is coming in from UK in Sept and planning to stay till Dec. We arent mailing off our K-1 till Sept, but we have had plenty of worries about them allowing him in for so long, but sounds like your k-1 was already files when your fiancee came to visit and they are staying there the 3 months with no problems! I hope our next trip goes as easy as this!

I am in the USA at the moment visiting my fiance for 90 days. This is my 3rd visit to the States while our K1 visa is pending. On each visit I was given a really hard time but they always let me through. I think this is because I can show ties to the UK (eg. a letter from my university stating that I am in the middle of a course). Also, I am always very honest & I think they can see from my track record that I always leave when I say I will.

If your fiancee can show relevent ties to her home country she should be ok. From my experience I've found that it is beneficial to me that I have a K1 visa pending because the officers feel that we've made the effort to do things properly & it wouldn't make sense to jeopardise that by overstaying or getting married whilst visiting my fiance.

Good luck xx

Like I said, I do not know how it will be for someone hailing from Russia, just how it was for us.

That said, I know that I was EXTREMELY panicked about him coming over this time to stay for so long... and told him to bring everything under the sun that he possibly could to show that he was going home for real...

He got a visitor visa stamp (at POE in Tampa) and was asked two things.

Who are you visiting?

What is your purpose for this trip?

And that was it.

(The answers were, respectively, "Friends, holiday")

Now, he's got to return in September, and if our visa isnt' worked out by then, we will have to be separated for this interim period. I wouldn't risk him coming back so soon... just to be turned away...
