Hello all.

I have to file a I-130 for my 16 years old stepson.

I'm a USC.

He's in the US.

Now from the instructions of the 130:

"Stepparent/Stepchild: If your petition is based on a stepparent-stepchild relationship,

you must file your petition with a copy of the marriage certificate of the stepparent

to the child's natural parent showing that the marriage occurred before the child's 18th birthday,

copies of documents showing that any prior marriages were legally terminated and a copy of the

stepchild's birth certificate."

I got this, but do I still have to send passport style photos of him and myself?

Do I have to send G-325As for both of us?

Don't really understand why you moved this topic.

I don't intend to bring my stepson to the US, because he is HERE in the US.

He's on proceedings, so my first step is to file a I-130 with USCIS.

Then AOS with the EOIR.

So I believe that this should be under family based AOS.

What do you think?

WHat type of proceedings is the child under? If the child plans to adjust from within the US you will also need to file a I-485 along with the I-130. Why was this not done when you filed for the parent?

It was moved in hopes of geting you better answers, maybe this bump will help and a little more explantion and answers can be given to help you.

Why is it that the only one who can stop the crying is the one who started it in the first place?

5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

WHat type of proceedings is the child under?

Removal proceedings.

Filed for spouse, but ran out of time and money, temporary.

Because he's already in removal proceedings, my understanding is

that I have to file I-130 with USCIS.

I can not (as of now) file for AOS, because EOIR has got the jurisdiction.

We need to get the I-130 approved, and the apply for I-485 with EOIR.

Anyhow my question was regarding the supporting documents to send with the I-130.

Do I send pictures and the G-325A?
