How old is the child? Who petitioned the child? the USC or the LPR?

Why is it that the only one who can stop the crying is the one who started it in the first place?

I am sure other may pipe in here but go ahead and File for him NOW as the USC, then it will take 9-12 months baring any RFE's. Make sure the mom is willing to ket the child come to line in the US permantly. ALso post this in the Jamacia forum as I ma sure many members there have been through this.

It is true as an LPR it will take 4-6 years for him to petition his son. My hubby filed for his son that was over 18 in Dec 2007 just got approved at USCIS on 2/24/10 now waiting for a visa number which can take another 2 years.

You as the USC can file for the child based on a step parent relationship.

** moving from "Adjustment of Status (Green Card) from Family Based Visas" to "Bringing Family Members of US Citizens to America" as the prior forum is for K1, K2, K3 & K4 visas so this is a more appropriate location**
