Hi all !!

my wife is a USC and I am a UK citizen.

Currently we both live and work in the UK but wish to petition to move to US.

I have a couple of questions regarding the I-1864 Affidavit of support.

1. Since we both live and work in the UK how do we fill in the form ?.. since our income is from

a UK job and not a US one

2. My wife is on a 2 year spouse visa in the Uk. I noticed on the form it says "the sponsor must

be domiciled in the US or its territories, does it matter we are filing from the UK

(the reason we are filling from the UK is becuase my wife has limited leave to remain in UK)

lquin,

You or your wife is going to have to develop a source of US-based income, unless she and you have sufficient, appropriate assets to overcome the income deficiency.

Your wife is also going to have to establish domicile in the USA. The anecdotal evidence with respect to the consulate in the UK is that she may not need to have established the domicile as long as she has begun taking actions to do so.

A Joint Sponsor can be used to overcome a lack of income or assets, but a Joint Sponsor will not overcome the domicile issue.
