Since your close to April - they may be requiring the 2009 tax year - you would have to call them to verify. (all though, according to my understanding, you have till the 15th of April before the current year becomes the recent tax year)

However, you said you sent the "completed form" - do you mean the 1040 she sent or something else, like a printout for Turbo tax? Your best bet is to get the tax transcripts from the IRS - has everything you need.

What the officer stated sounds correct, if you did it within one year (the AOS) of the last medical, you should be gold. You didn't have any missing vaccinations by chance, did you?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Ah - that is why you have the RFE for the income tax, as per the 864 instructions:

Telefile tax records are not acceptable proof of filing

I'm thinking the turbo tax thing is considered telefile.

I would get the transcripts (as the instructions state) and then with the vaccinations, the info you sent before, and a statement explaining the K-1 medical and 693 requirements (no medical needed if within a year - as per the 693 instructions).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

We got the same "out of date" RFE on our medical.

I wasn't comfortable with simply sending in the same information, so I had my congressman do an inquiry to make sure the medical and such was in the file. They can get into contact with someone who actually has access to your file - something you can never do on your own.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

More detailed time line in profile.

I'm not all that familiar with the U.S. tax system, but isn't 'telefile' a program that was in place and is now discontinuted (in looking it up I see they discontinuted it in 2005)?

I would venture to say the reason for the RFE is because you did not send in the W2 slips with the tax return. If you send in an IRS transcript, you do not have to send the slips, if you send in a 1040 you must also send the slips that support the figures.

I believe turbo tax can file the tax return electonically - which may be the reason they rejected it. (you can also print out the forms to send in, but unknown if they were signed by the OP, if he electronically filed them, i'm thinking "no")

The OP did state they sent in the W-2's, so that wasn't the reason.
