Hi folks, I am in process of filing for I-130 and just realized that i have my spouse's G-325A form completed and checked with "IR-1 Petition", since we have been only married for 3 months, will it delay the process? Should i change to CR-1? Does this matter?

This will delay the filing process since i have to wait for the form to be signed and mailed..

I'm not sure I understand where you have "checked with "IR-1 Petition" but it should not an issue. Your date of marriage and therefore eligibility for a CR1 will be clear from your marriage certificate. If you are uncomfortable sending it in as is then certainly redo it. Good luck!

I'm not sure I understand where you have "checked with "IR-1 Petition" but it should not an issue. Your date of marriage and therefore eligibility for a CR1 will be clear from your marriage certificate. If you are uncomfortable sending it in as is then certainly redo it. Good luck!

On Form G-325a there is a field where it asks "This form is submitted in connection with an application for:" the choices are Naturalization, Status as Permanent Resident and other(specify), this is where i have put down "IR-1 Petition".

It's been singed by my spouse overseas and it took me almost 15 days to receive the mail, I do not want to redo this process again if i don't have to..

Thanks for your quick response, I think i will just go with what i have filled in there..

They will understand just as it is so don't sweat it. However, it is important that you understand there is no such thing as an IR1 petition. You're filing an I-130 petition for alien relative. In this case the relative is a spouse of a US Citizen. The process could eventually result in either an IR1 or CR1 visa depending on when the visa is issued.

Facts are cheap...knowing how to use them is precious...
