Hello I need some advice, I recently file my AOS and I my NOA1 and 2 but I will be graduating in May 2010 and my visa will almost expire in 23 May 2010, will I be out of status after May 23. What should I do.

If you have the NOA from the AOS, you are in safe status, "applicant adjusting" - so your good to go. Also, I am betting your I-94 states "D/S", so only an IJ can determine if your out of status, but that has no bearing with you, since you filed for the AOS.

However, if your AOS is denied, you would probably need to go back to your home country if you can't appeal the denial, since you have no basis to stay in the US.

I would suggest you keep a copy of your NOA and marriage certificate with you, along with any other ID, in case ICE stops you for any reason.

u're good... as long as you filed the AOS u are no longer bound to F-1 status
