2nd biometrics for the same petition? Does biometrics EXPIRE?

Hello for everyone!

Last week my husband got 2nd biometrics appointment. We called with a question why and got an answer that his bio he gave 2 years ago EXPIRED.

Does anybody have an oppinion about it?

The following is a timeline of this petition (I130), in case it matters. I live with my husband in the US.

02/04/2008 Filed I130. Included copies of certified police records, court dospositions and etc... (Copies because the originals we sent for RFE for my 1st case, which was denied because me missed 30 days of deadline we were given. After denial our lawyer advised us to reaply, but we had only 30 days to rdo it and that was cristmas/new year time. Remembering the first time, it took us a months to get records, so we sent copies with an explanation letter. Lawyer said that is OK, in the worst case they will request originals.)

02/25/2008 NOA1

05/18/2008 My husband's biometrics was taken

03/2009 Notice that case was transfered from California Service Center to a local office

08/11/2009 Interview. On the interview the Officer was looking through records with my husband and taking from our set of copies pages which were missing (we had one more set of copies of records). Apperantly when the case was transfered some pages went missing. So, seems like USCIS assepted copies of records...

The officer said on the interview that she will send us a letter with request my husband to prove he doesn't pose risk to me (NOID). We never got that letter. From what I learned talking to differen people, they were getting RFE or NOID right on a spot after interview. The same was with our first case. Why didn't she print it out on a spot or didn't send it later at least?

02/2009 Infopass appointment. Learned that my case was not touched since interview and nobody was assighned to work on it. We were said that now withing 60-90 days somebody will be assigned to it and we sould get something on a mail. Most likely NOID, she said.

03/2009 biometrics for my husband, the one I started a story with! Interesting moment: it was sent from California Servise Center amd we know that case is in local office. We didn't get a letter saying about transfering the case back.

What is going on? Do I have 2 cases in California and in Minnesota? Why 2nd biometrics? Usially after Biometrics they confirm is my husband falls under AWA or not, but that is already well known. The lady on the interview knew it.

Guys, any oppinions, comemnts?

Biometrics are done in the first place to prove that the person they are interviewing is the person they are supposed to be, to prevent visa fraud. It's like an additional form of ID.

If your case is about to be rehandled again after sitting dormant for so long, they need to reconfirm the biometrics. It's just standard, I think.

So... I'd take it as a good sign that there will finally be some action taken on your case!
