Hello All!

I've been a member for quite some time, but hadn't visited much until I recently sent our I-129f petition in just a little over a week ago. Even though Joynelyn and I have only just begun our journey in this process, I have a long range question.

O.K., let us just say that everything goes well and after she receives her Visa to come to the U.S., I shall go to Cebu City, Philippines to accompany her home. But while I'm there in Cebu we marry there so that family and friends can be a part of our union. Now we are married, but she is entering the U.S. under a Fiancee Visa. Is this a problem? I mean, when does the 90 days start, from the time the Visa is granted or from the time she actually arrives in the U.S.?

From the time she enters the US. If you get legally married in the Phillipines then you can't use a K1 fiance visa...

12/15/2005 - Sent I-129F to Vermont Service Center

12/17/2005 - VSC receives I-129F via express courier (day 1)

12/23/2005 - VSC officially sends out NOA1 stating receipt

01/05/2006 - Called the National Service Center and got NOA1 receipt number.

01/10/2006 - NOA2 received via USCIS website and email. VSC is blazingly fast! (day 22!)

01/20/2006 - Receive NOA2 via snail mail in Thailand

01/26/2006 - Bangkok Embassy confirms our case is in their system (day 38)

01/30/2006 - Dropped off checklist and doc's with embassy

01/31/2006 - Received email from embassy confirming our interview date 3/20/06! Woohoo! (day 43)

02/08/2006 - Received police report and packet 4

03/01/2006 - Medical Exam completed

03/20/2006 - Interview! (day 91)- SUCCESS!

03/21/2006 - Picked up VISA!

04/04/2006 - Fly to USA together to get officially married in US and to start our life there together!

04/07/2006 - Arrived at JFK, C received temp EAD stamp. Drove to MD to live!

04/20/2006 - Applied for SS Card in maiden name, received it 3 days later

05/12/2006 - Officially married in the US! (2nd ceremony)

05/15/2006 - US Reception

05/16/2006 - Applied for new SS card with married name - Applied for EAD

06/01/2006 - Applied for AOS I-485

10/27/2006 - EAD Approved!

If you're married technically you can't enter on the K1. Well you could enter by saying your not married, but then getting married again to stay would be tough.

Best bet is to have a ceremony in the Philippines that is not a legal wedding. This way her family could enjoy it, and she's still able to use a K1. I don't know the law there, but as long as it's not considered a legal marriage your fine then.

Then when she gets to the USA go to the justice of the peace and make it legal.

Or you could go back to the Philippines once you have married here and I have a wedding there for her family and friends.

My fiancée and I will have a Civil wedding here and a Catholic Church wedding in Colombia once she can travel. Hope this helps.

I think most will admit that you can have a religious ceremony and a legal ceremony. One can be married, but still not legally married.

Either have a religious ceremony there, and not sign any legal documents, marriage certificates, etc., and then enter on a K-1 and have a legal marriage in the U.S., or do what others have suggested and hold off having a ceremony in her countrly until after you have alread been legaly married in the U.S.
