Hi all,

We are finally starting the AOS process and have the first of what I am sure will be many questions. lol. On form I-485, the question is:

List your present husband/wife,all of your sons and daughters

family name

I was previously married. Does "family name" refer to my maiden name, or my previous married name? I am thinking maiden.

Hi all,

I was previously married. Does "family name" refer to my maiden name, or my previous married name? I am thinking maiden.

First I just want to make sure you have the correct form because it was updated (I downloaded mine when I immigrated in Sept so they've changed since then :P). Your form should expire 12/31/2010 and was revised (this is at the bottom of the page) 12/03/09. The NEW form, says "Family name (last name)".

I'm a little confused about why you're asking about you...

Are you the immigrant (female)? Or is the immigrant male? If the immigrant is male then the question is asking for the LEGAL name of your wife as in RIGHT NOW, not former name. If your spouse (female) changed her name to yours then THAT'S the last name (family name).

If the immigrant is female then this qn is moot I thought BUT on page 1 when entering her info she would write her NEW last name in and in prior names she would write her previous LEGAL name. So if she entered on a K1, what was the name on the K1? That's what goes there.

It's all very confusing because I don't know the immigrants sex BUT for example but you must show the path of name change or you'll get and RFE. As an example, your birth name was Jones (evidence is birth cert), Smith is previous married name (marriage licence show Jones to Smith & divorce decree shows name STILL Smith, as do K1 visa and marriage licence show this is still last name) and you married a Chan (new marriage licence is evidence of change from Smith to Chan).

I am the USC, and female. My husband is the immigrant. So, I should put my new married name there?

Okay and yep :) If you've changed your name to his, then new name it is. :D
