Hello everyone,

I need an urgent guyz. Today I called the NVC and they informed that my co-sponsor filled line 10 in form I-864A incorrectly.

current individual annual income

Where do you get this information from? (from employee , W-2 form?)

Are they asking for annual income after taxes or gross income?

It's income before taxes.

You can get it from your W-2 or 1040's (or tax transcripts) (which should of been provided with the 864A)

Did the co-sponsor put the incorrect value or not send in the evidence?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yes, my co-sponsor provided NVC with tax returns statement for the past 3 years we mailed with AOS package. So, basically they have all the information they are asking me about!!

The NVC said line #10 in I-186A is filled incorrectly! and asked to resend form I-864

Please let me know how to answer questions 10 and 11. This information is for my co-sponsor. This is confusing me so much. Where do I get this information exactly? Where on the W2 or Form 1040? Which lines? I just can't afford to waste any more time! I'm sure many of you feel this way.. I hope everything works out good for you all.

It's the same answer. Only if you actually filed using a 1040EZ would you use the adjusted gross income.

Hi pushbrk,

My co-sponsor said he most likely filled line 10 on the initial I-864A according to what's stated in his federal tax income (page 2). Unfortunately he didn't keep a copy to confirm what was mentioned. However he included W-2 statements & federal tax return statements for the past three years. So, NVC already have all the information they are asking for in the tax statements!

So, I don't really understand what is the mistake we did. (was a typo error?!).

NVC did not enclose excatly what they want apart from saying (line 10 on form I-864A was filled incorrectly)!

Will re-mail the I-864A tomorrow and will mention in line 10 total income according to federal tax return page 2.

Thank you Pushbrk, I am DoctorM's wife. Our co-sponsor did not make a copy of the I-864A unfortunately, and it's caused a great confusion. We are sure that he typed in the amount on question 10 from line 22 on his form 1040. To make matters worse, we now don't even have a copy of that! So now he is sending the new I-864A with question 10 answered from total income on page 2 of his IRS transcript.

What is making it all the more confusing is that today morning an NVC operator told me question 10 is to be answered from either line 1 or line 3 from the co-sponsor's W2. Now lines 1 & 3 have the same amount and they are different from the amount under total income on page 2 of IRS transcript.

Now if things couldn't get any more dizzying, his current income on my form I-864 is the same amount from page 2 of his IRS and I couldn't understand how the same amount wouldn't have been written in question 10 on his form I-864A. I just do not know where it all went wrong.

I really do not know how to proceed in order to avoid 2nd RFE.

I am waiting for an NVC representative to answer the phone to get whatever information I can, but I still would greatly appreciate any input you may have.

Perhaps it was a joint tax return? If so, he must state only his personal income which WOULD be the biggest number on his W2 form. In that case, you would use a tax return not transcript. If not available then a transcript plus a W2 copy.

No it was not a joint tax return as my father (the co-sponsor) is the only one working in our household. His total income on IRS is 78,172.00 and on lines 1 & 3 of his W2 it is 78,000.00 He told me the 172 on his total is from some banking interest. I just got off the phone with an NVC representative and he said if it's not a joint tax return then he could put in the amount from 2nd page of IRS transcript. We had included copies of W2s as well as the 1040 and IRS tax transcripts in the first package. Could the different amount on the W2 be the one causing the problem?
