How does I-94 and overstay time work

It is my understanding that the US gov't doesn't check the credentials of those leaving the US, including those holding I-94 forms. How is it that these forms and departure dates get recorded with the US government?

The airlines are supposed to remove the I 94 form from your passport as you exit the US. Not all of them are great about it, though. There also was a pilot program a few years back where CBP agents were scanning departing passenger's passports at the gates (hubby had to do it a few times) -can't remember now what that was called or whatever happened to it.

As Tracy says the airlines are meant to remove them and send them in. If that doesn't happen you are meant to post them back with proof of departure. If neither happens it can be assumed you are still in the US or overstayed and it might cause you problems in the future. It also might not cause any problem at all.

If neither happens it can be assumed you are still in the US or overstayed and it might cause you problems in the future. It also might not cause any problem at all.

My Fiancee handed her I-94 over to the airlines when she departed from the US (B2 visa). She didn't overstay, but I want to know how I can check with the gov't to see if they have an accurate record of her departure?

PS- Would a Consular record (for K1 visa) on a certain date abroad also count as proof she didn't overstay?

You won't be able to check the government's records, the only way to find out if there is a discrepancy between what they have and what you remember is if you put your dates on the forms and then they question it at the interview.

Not sure what you mean with "Consular record (for K1 visa) on a certain date abroad"? If you mean she had an interview at a US embassy on a certain date then yes, there will be a record of that and thus she could not also have been in the USA at the same time.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Don't you have to show your ID to get on the plane? The airlines have the name of every passenger on the flight. Even if they don't collect the I-94, they know when you leave.
