:) Folks I think there is far to much speculation that is going on here. None of us knows that much about the inner workings of the USCIS. What most of us know is based on what we have read on this VJ site. Lets try to minimize the spreading of rumors or taking things being said as fact. I dont know but do not believe filing a I-129 would speed up the process for anyone. I have to believe that the US Government would give family (Spouse and Children) priority over most other applicants. It just makes practical sense to me. I would not focus on touches as they mean little to nothing. I have dealt with government entities for many years and they truly do follow rules. The problem, if any, is that they are spoiled workers who don't perform at a fast pace much of the time. They do however try to be fair and give equitable treatments. Of course you still have the human factor to deal with but I dont think it plays that big of a role.

Just do your best to complete the forms and follow the instructions. Mistakes will be made and corrections will be required. If not then be happy. I read somewhere where an Attorney forgot to add photos. So relax and most of all dont let your mind play tricks on you. We all want to see and be with our loved ones. That is probably the most common trait we all share. Just try to stay positive and dont react to ever comment.

Does sucking up to the government help speed up your case?

If it doesn't, why do some people like to suck up. Especially here on VJ given that the government doesn't even get to see these sucking ups.

I think the whole touch thing is somewhat overrated. From what I have read on this site, there is not much of a correlation between touches and approvals, i.e. many people get approvals without ever seeing a touch. As for the filing of the 129, I have talked to many people about this (attorneys and consulars)and they all told me that the 129 was not worth filing. They told me that the 129 usually gets approved about a week ahead of the 130, making it a less attractive option than before when the 130 was taking over a year to get approved. As soon as the 130 gets approved, the 129 is canceled. And if you do come on the K-3 visa, there are a lot more steps and forms involved down the road, though being together far outweighs the extra steps. The key is patience, which is really difficult, particularly given the way the USCIS works.

Very good point. This is one part which I never liked too much. But I already filed the I-129F so there is nothing I can do about it now. Maybe if my I-130 gets approved before the I-129F, I can ask USCIS to cancel the I-129F app. We'll see.

You don't have to cancel the 129. It gets done automatically. I had a fiance visa on file when I applied for my 130. One week after sending in the 130, I got the approval for the fiance visa but as soon as they received the 130, the fiance visa was canceled.

If so, then why would one worry about the extra steps that are involved in getting a K-3 since there will be no K-3 altogether?

If you file for both K3 and IR1/CR1, the moment USCIS realizes you have both K3 gets terminated. Your spouse will get IR1/CR1 visa. I don't know why people file both. It's pointless. File either for K3 or file for IR1/CR1. K3 takes 3 months. IR1/CR1 takes 6 months. But in recent months IR1/CR1 was also taking only 3 months. So there was no point to file for K3. But now that IR1/CR1 takes 6 months again, people may consider filing for K3.

If you've already filed for IR1/CR1, there's no point in filing for K3. But it's your money. Waste it however you like.

Poor Tom. At least you tried to calm the stressed out peeps. All we can do is wait. I will hopefully have some answers about whether my AOSer is going to be my AOSer or not and possibly about my husband's papers. That will be nice if both happen today. I hope everyone is having good weather where they are. I'd hate to be in a rainy place during this whole process (unless you love the rain, then more power to ya). Luckily no one has had to wait 6 months yet (and *crossed fingers* won't have to). As long as those who are waiting have everything ready that they need to/can get ready at this point, the rest will be so much nicer (minus the waiting for SIF/CC and interview depending on when you get done with NVC).

Who gets to go be with their loved one for an interview?

Thank you for claifying this.

Please note: Filing I-129F after you have an I-130 receipt qualifies ALL petitioner's for the fee waiver. So, the cost really is the cost of some ink and postage.

Right.

So, based on what you said (since I filed I-130 already) she will NEVER get a K-3 visa and thus no extra green card steps will be involved.

Who gets to go be with their loved one for an interview?

I am planning on going, even if the embassy will not allow me into the interview room.
